Holiday Misrepresentation - Can you Claim?

Does anyone have any experience with claiming for a holiday you've been on?
I have just returned from a holiday in Egypt. It was an all inclusive water park with full entertainment. Unfortunatly the water park was only open on demand and then only one slide at a time which took about 15 minutes and then only if you could find a lifeguard - there was no children's clubs as advertised and only 3 instead of 12 nights entertainment - only 1 of 3 restaurants was open - only 1 of 4 specialty restaurants were open. The hotel was running at 10% because it was mainly only English guests. My argument is I paid full price for my holiday and feel I should have recieved the full facilities as advertised - my travel agent advised the holiday was fine and at no time told me the facilities would no longer be available.
I welcome anyone's views or take on this - thank you!

There is a pretty obvious reason why the resort was running with few staff and limited facilities, so I doubt misrepresentation would be suitable. Which resort was it?Gone ... or have I?0

Titanic Beach Spa & Aqua Park, Hurghada, Egypt.
I did contact the travel agent prior to going and was not advised the holiday would not be what we paid for.
Where as I understand why the hotel was not up and running as it should have been I feel the travel agent took a full fee for a holiday and should have given me the option of going or re arranging and the holiday supplied was not the holiday paid for.
I did complain to the hotel but unfortunately the owner was not in Egypt as he felt it was too unsafe!!0 -

Did you ask them to re-arrange?
Presumably you were watching the TV and knew what was going on?
I presonally think you have some responsibility to re-arrange if there are widely advertised national problems which is blatantly obvious will cause problems.
I strongly suspect you won't have a legal case here as there will be some small print that says that the facilities are not guaranteed if they have to be closed for "operational" reasons. What was going on in Egypt where people were getting killed certainly justifies them not providing the facilities.
I'm not being unsympathetic BTW - I am just presenting the legal view which I assume you want and that is that it's almost certainly covered by small print.I did complain to the hotel but unfortunately the owner was not in Egypt as he felt it was too unsafe!!
Does that not indicate to you that should have done some investigations of your own beforehand?0 -
I did speak to the travel agent and they advised the holiday was perfectly safe. The travel agent were not prepared to change the location of the holiday as the foreign office in UK stated the area was safe. They advised I either went on my holiday or lost the money!
Some may say I should have lost the money but this is the first holiday with my hubby and children for 7 years and we are not in a position to throw away money.0 -
I claimed successfully against Thomson's a few years back. The basis of my complaint was that the brochure advertised entertainment at the hotel 7 nights a week but it was only provided on 3 of the nights. The area was quiet so we ended up getting a taxi into a neighbouring resort on nights when the hotel didn't provide entertainment
I wrote a letter on our return and was offered £150 cash or £200 in vouchers (I accepted the cash)
In my case though, this was the Canary Islands in the main school Summer holidays08 wins £3000+ :j09 wins £4408:j2010 (6 months off) £2004:j2011 £10,003 :j 2012 - £6013 :j2013 wins £8500 :j 2014 £5530 so far....0
