Stamp duty refund

Just wondering if anyone can help ? I purchased a house in October 2005 which qualified for disavantaged stamp duty area relief (internet HMRC search ) However my solicitor at the time insisted it still needed to be paid, so not wanting the sale to be delayed I paid the stamp duty. Is there any chance I could reclaim the tax paid ? thanks

    I don't know the specific answer but I wonder whether a strategy would be to write to the HMRC, asking for confirmation of whether your specific transaction required payment of Stamp Duty at the time and, if so, how to obtain a refund. If it was definitely exempt, but they won't now refund for whatever reason, I'd be looking to the solicitor to recompense me. Do you still have your completion statement from the solicitors to prove that you paid an amount to them for SD?

    Hurray - received stamp duty refund for about 1200 ! I did have to pay solicitors fee but dont think I would have got anywhere with HRMC in time as getting close to 6 year deadline .

    I hope you didn't pay a fee to the same solicitors that wrongly advised you to start with!!!

    If I was you I'd send a copy of the bill to the original solicitor to claim the cost back from them, plus lost interest on the £1200 that you've not had the use of.

    Hi there I have just received a letter from a claims company saying that I could be entitled to a refund and I have checked on the HMRC site and my postcode is in the disadvantaged area so I was wondering did you use a claims company or did you go through your own solicitors? I moved into this property 8 years ago so may be outside the claim period but it may be worth checking with our original solicitors as the claims company say its a no refund no fee or 30% of any refund.

    30% to call up HMRC, explain the situation and ask them to give you the money? Nice work if you can get it.

    Hi Stormrogue - I used a claims company - think fee was about 395. Could have gone direct to HRMC but didnt have clue where to start !
