Of course you realise this means WAR!!
Was the first thing i thought to myself when i opened the mail this morning only to read another letter from this fredrickson lot saying that they now demand full payment since i have failed to pay them anything despite repeated requests for payments??
They only sent me one request and they wouldn't talk to me when i called them to tell them it wasn't my debt!
So i am writing a letter to them in reply in the standard manner.
I do not acknowledge ANY debt to your company or your clients. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
Then i will let you know what happens next.

Fredricksons are well known bully boy debt collecters. chances are they are trying their luck. the letter should do the trick. Make sure it goes recorded delivery.
Just a though remember A&L took over a lot of smaller institutions over the years any chance it could be one of them you owed the money too?
Even so the way fredricksons behave tell them to go get lost and sue you if they want any money!!

Hi,
Just been reading your post. I received a letter from Fredrickson International Limited a week ago saying I owe £8816.92 to Alliance and Leicester too. This was also re Arrow Global Limited. The letter content was the same sort of thing as you had. It said DO NOT IGNORE IMMEDIATE PAYMENT REQUIRED! I have never had any debt either to A & L. Previously to this about four weeks ago our neighbour came knocking on our door saying that a trace company had rang them and left a no for me to ring back urgently. Rang the no it was a group called J2Solutions after doing a bit of homework on the internet found they are part of group Mackensie Hall who by the sounds of it are a under hand debt company!! Also since an old neighbour has been in touch too saying they rang her!! Then surprise surprise four weeks later get this letter from Fredrickson International Limited!
Today received another letter saying 'LETTER BEFORE ACTION' on this one it says balance is now 9862.27 gone up £1,000 in one week!!! They have added 705 interest and 340 costs!! Sure this is a con but is quite worrying even so. What do you think I should do - a lot of websites say ignore but others say do letter like you are doing? Am interested to know what happens with you.0 -
This sounds like fraud to me I would contact the police in either case, Or go to a A&L branch just too spooky its happening to 2 peeps on this board

I don't know if this helps but we had a similar problem with bailiffs about 12 months ago, i called the company and they wanted details i wouldn't give um out, I spoke directly to the court that was handing out the fine and cut out the middle man, i still had to go to court but they asked me if i'd ever lived at some other address and said my date of birth was 1952 the hearing was 2 days after my 25th birthday. and i walked away without a blemish.
What i'm trying to say it contact A & L, this is a big company one which you know deffinatly wouldn't try to scam you and will probably be able to tell you wether this Arrow company is supposed to be working on there behalf.
If all else fails tell um to send it to court as they have to have a signed credit agreement by yourselves to prove you owe them in the first place.

Thanks mercedes280e this makes it all the more interesting. I am just off to the post office just now to post the letter recorded delivery and wait for a response.
It sounds like a serious fraud attempt is going on somewhere and i am hoping that the information this fredrickson lot send me will make it all the more clear as to what's happening here.
Fredricksons were addamant that they would not talk on the phone until i gave them personal info ie date of birth and so on and i am not giving that out to the like of them over the phone yet their latest letter insists i call them to talk about it??
I have stated in my letter that i will not deal with this matter in any form except in writing.
Also just to amuse myself you know all letters from companies have references? Well i started putting my own references on letters about a year ago, it's usually the company i'm dealing withs initials and the date but im putting this reference for fredricksons (FOYW281106) use your imagination as to what those letters stand for, no the f does not stand for Fredricksons.
Anyway i'm off to the post office. Will keep you all informed of the goings on as soon as it happens.
I also put in an extra paragraph to my letter stating that "I will only correspond with you in writing on this matter as i will not give out my personal details over the phone to a company that i have had no dealings with or have never heard of. This is to protect myself against identity fraud and is the advice given by all responsible finacial institutions and is something that a company in your supposed line of work should be aware of."0 -
