Mistake at the Dentist - Who is Liable

    Oh I agree that the dentist must take some blame. I think that there has been a bit of a breakdown of communication.
    I get the impression that yu have had most of the conversations with the receptionist where it should have been with the dentist.

    When it comes down to it though, you have had the work done and its all done and dusted.
    Ask if you can pay in installments. Im sure after they have realised what has happended they will do their best to accommodate you
    under the circumstances.s

    My dentist called it a quote and I thought I was signing it to agree to the price quoted.

    So what do you think that the above means.
    It means that you are agreeing to have the work done at the price quoted.
    What you actually said doesnt mean a thing once you have signed a 'contract'

    My OH was a decorator, sent off quotes, people sent them back, signed. It meant that they agreed to have the work
    done at the price quoted. He just had to ring them to arrange a date to start.

    I'm very pleased with the work my dentist has done, I have no problem with that and yes the crown did need replacing at some point but I'm just annoyed that my choice to go back to my dentist, when I could afford to do so, has been taken away from me. I now have no option and I'm saddled with a debt I cant afford to pay back.

    I'm sure it's all upsetting, but here's the thing...

    They have a contract signed by you.

    The rest of it boils down to miss-communication and is "I said-they said" and "I thought-they thought".

    That's going to be a difficult one to resolve, certainly you can attempt a case based on "deliberate misrepresentation" as opposed to "genuine mistake"...

    Really, try working something out with them first and if you don't like what they offer then look at other possible options. Your local Citizen's Advice Bureau should be able to help.

    Most dental plans are pay X amount a month anyway, so should totally cover the cost of any treatment you receive

    unfortunately as you signed the agreement the dentist made out you signed for all the treatment he had written down. if you didnt want your crown done for a while you should have made him print out a new one WITHOUT the crown on it and signed that. That would have meant he would have to take it off his treatment plan and then wouldnt have gone ahead with it.

    to say that he should have remembered...well it doesnt work that way. the treatment planning takes 10-15 mins, depending on how much you pay.
    the dentist then goes on to see numerous other people in that time and will most likely forget what was said.

    Unfortunately since you did sign the agreement agreeing to all treatment taking place I dont think there is much else you can do...
