Re leaving your employer without notice, I basically agree with Storm (although, actually, injunction proceedings just have to be issued without reasonable delay, not on the first day).
The reality is that, particularly if you are not working currently, there is naff all that the company can do. They would have no grounds for injuncting you from joining a competitor (as I understand that you work for the council. Who are their competitors exactly?!) and there would be no damages from your breach of contract (i.e. they haven't lost money from you not serving full notice). If you find a good new job, don't let the notice period stop you.
On the DDA issue, I agree with the others. Ask for a copy of your report- under the Data Protection Act if you need to. Have you filed a grievance about the way that they are treating you? If not, it sounds like the time is right... Often, a kick up the bottom is what these organisations need.0 -

surely this is constructive dismissal? Ask union rep... they are making it impossible for you to work there even though you are able.
IF that is the case, feel free to take any other job you like.. then go to Employment Tribunal.
Have they followed their internal policies and procedures to the letter? Have you made sure you have a copy of them? Have you asked in writing for as copy of them?
Have you raised a formal grievance and pursued it as far as you can?Debt free 4th April 2007.

Hugs Lynz you have been so helpful to many people on this forum. When did your last sick note run out? If it overlapped the last day your company could pay your sickness benefit they should return this to you. They should also give you an SSP1 form to say why they can no longer pay you sick pay i.e in their case you had already been paid 28 weeks sick pay. This is the form you need to apply for incapacity benefit. Google SSP1 form to have a look at this.0

I'm a newbie here and was saddened to hear of your situation.
I haven't had time to go through each reply, but you are entitled to DLA (disability living allowance) this is non means tested which means it doesn't matter if you work or not and your wages or your husbands isn't a factor in the decision making process.

I'm so sorry to hear about your circs, I'm not able to read all the replies at the mo but want to post - sorry if this has already been said.
Unfortunately the real key is to scream and scream and scream until you are sick. Get on to everyone, especially your MP. MP's get results, complain and copy the letters to anyone who could possibly care, thats the only way to get results in a serious situation.
1. You are fit and willing to return to work, why are they not finding some jobs for you, maybe not a new position but getting you doing filing, typing etc. Are you in the Union? If you are or even if you are not go crazy. Letters to the head of your union, head of HR, head of your department, the head of your division and your MP are in order here. Emphasise you want to, are able to and am willing to work at ANYTHING.
2. Under the freedom of information demand copies of all records they hold on you.
3. Speak to you doctor, I was assaulted by a work colleagues husband and could not return to work, my doctor was great I was fit to work but could not face going back there (the assault was out of my companys remit). She signed me off on a weekly basis until I found a new job. Worth a try, incaps not a lot but its more than you have. - Also get your doctor to write a report on how much stress this has caused you, how much it has contributed to your illness
4. If a lot of the debt is to your parents can't you stop payments for a while, surely they know you are ill and would not like to place extra stess on you when this situation is not your fault.
5. Contact your CAB and your homelessness department. If homelessness say you are intentionally homeless because you sold your house get very angry and kick off head of department again as to why you had to wait before your mortgage was in serious arrears and you were facing a court order before you could ask for help. When you can no longer pay your mortgage you are really homeless. Again your MP, he wants your vote make him, or her work for it!
6. Can your housing association help? They may be willing, and might be able to offer additional support, most big associations have supported housing departments that can assist with debt and homelessness. Maybe even ask them for work? I used to be a housing officer and recruitment was a massive problem.
7. Crisis loan, worth a try https://www.jobcentreplus.gov.uk, without a deposit you can't get a place to live and as far as I see thats a crisis. By the way get angry that gets results. Again, its rubbish isn't it, you've got to have the front to stand up or you get nothing..
7. Sue, sue, sue, sue, they are trying to take the pi$$ out of you. This is out of order. You want to work, are willing to work and are fit to work. They should be deploying you somewhere else for a least a day by day basis. You'll find a thousand solicitors chomping at the bit to take your case on.
What makes me really angry is that council workers are given a bad name by people that are constantly signed off for one pathetic reason or another. And the wasters then come in for two days every few months only to shout out loud are given the royal treatment. People that are really ill and who want to work who are messed about and treated like scum. I know because I work in one but the cushy council life is there for those that work the system. The true wasters have their job back no matter how long it takes.

Oh I will add one more thing. If its not to your taste I'm sorry and I have no intention to offend anyone, I'm trying to offer Lynz some options.
A possibility is telephone chatline work. Even on a bad day its well above minimum wage, if you applied and were successful (which isn't hard) you could start earning this thursday and get paid a week friday. and then on a weekly basis. Best thing is your minimum work is only 10 hours per week logged on. You can keep it going through a temp job without stress and have the option to increase hours when you have no job.
If its an option please PM me, I would be happy to go through it all with you and give you some advice. All you need is an open mind, a fixed phone and internet connection.
Don't consider doing this is you can't be relaxed and open-minded, but its easy and most of the guys that ring are very nice.

Sorry to hear that your situation isn't improving lynz, its maddening how you're being treated!!
I don't have any advice to give really except that it really is ok to get mad about it, to make a fuss and complain to everyone! I know you say you don't want to be seen as a trouble maker - but do you really owe them anything? I'd say quite the opposite... they owe you a hell of a lot and I hope you get compensation for all this somewhere down the line. Its a sad fact that often things only happen when we complain... its not nice but its life and you deserve to get everything that you can from them, by whatever means it takes!
