If you have no evidence other than word of mouth, then you might find it difficult to claim compensation.

At the end of the day though, even if you complain and win, you are not going to suddenly get the loan paid off if that is what you are thinking.

You are most likely to get a token gesture of £50 - £200.

By all means complain, but you have to weigh up whether it is worth the time and effort to do so, particularly as you have no solid evidence it appears.

No, I recieved no paperwork as I only recieved a call to say that the loan had been agreed and that the money was in the joint account. The only paperwok that I recieved was the pre-contract agreement and the credit agreement which has no account detals on it apart from the loan account number. I have not even got a copy of the direct debit mandate.

Surely you should be receiving some paperwork comfirming the loan, the terms of it, the length of it and the repayments, plus the bank details for the DD?

Sounds like someone's made a big c0ck up somewhere.

Depending on what side of the bed they got out of, users like zppp are typical bare-faced bank suckers up unfortunately.

All I have asked was three questions to the OP. Would you like to elaborate as to why that is sucking up to banks?
    Best Regards

What law do you think they have broken?
Combative when you know the complaint is about a breach of a sensitive agreement.
What information did they divulge to your husband?
Again combative when you know perfectly well what the information was - husband is a joint account holder who now has his data linked to a mystery credit within the bank's database. If that isn't information divulged then what is it? When exactly was he to find out in your book ... never?
Also where does it says the loan funds are to go to on your loan agreement form?
Yet again combative when you have been told the whole story.

All in all that results in you lending credence to the banks when it was clear from the original post that something was badly wrong.

Your attitude thus far on this thread means you have not even begun to assist the OP. Sorry and all that ... (not my bed but I suggest you try the other side tomorrow ;)).

My next step would be to make a subject access request to your bank, asking for all details of any records they hold, recordings, ... that in any way relate to this.

Search subject access on the search box above.

This is the data protection act - it's a way to get your data from companies.
They may have written something down that you can use in a complaint.

Let's get some facts straight shall we. I asked a question about the OP's loan agreement, which other users have asked since I did? Yet you don't jump on them when they ask a question.

As for my other question in the same post regarding the information, that is very specific. i.e. Does it say on the bank credit - Loan Credit? Presumably a loan being paid by Direct Debit, is that on the joint account? etc etc. It then may help the OP find the answer as to whether there is a breach or not.

As for your personal comment about me, you are entitled to your opinion.

I agree with others about the secrecy but that is a domestic issue.

As far as data protection is concerned, the bank should treat spouses as separate individuals unless those individuals indicate otherwise, so I think the onus would be on the bank to demonstrate that the OP had done so.

So I think a complaint would be upheld.

I had to tell him. What was I meant to say when he asked why there was £5K showing on his statement that he knows nothing about. I dont know why they would only let my husband move any money, santander have some very different rules to other banks.

Yes, when applying for my loan I only gave my sole account details.

In terms of the 'breaking the law' I am sure that the bank are in the wrong for disclosing my personal information to a third party?

ok if you are sure then you dont need help here just sue them

My husband knows that I have my own account with them but obviously he has no access to this account and hence this is why I wanted the money to go into this account.

I have no idea why they put the money into the joint account as at no point in the application was this account mentioned and the bank could not even tell me why it was put in that account.

which account did you request the repayments be taken from?

People please don't argue with each other I just wanted to get people thoughts on this. I only discussed my accounts with the staff member, at no point did we mention the joint account and I had said that my husband was unaware of the debt.
