Did my bank break the law?
I went into my bank and took out a personal loan in order to pay off credit card debts that I had built up. The loan was taken in my own name as I did not want my husband to know about it as he did not know about the credit cards.
When the loan was agreed I recieved a call from the bank advising me that the loan was agreed and that the funds had been placed into my account. When I checked my balance the money was not there. I called the bank back and they stated that the loan money had been put into the joint account that I hold with my husband (his account).
When I asked why it had been put into that account as I didnt want my husband to know they advised that they were unsure but said that if I could get to a local branch they could transfer the funds to my own account.
I went into the closest branch and asked them to move the money but they told me that only my husband would be able to move the money. A little while later the lady dealing with my loan called me back to ask if I had managed to transfer the money but I told her what had happened and that I couldnt. She then stated that she could try to link the accounts on my card so that I would be able to transfer the funds on an ATM and then take the 'connection' off again, but I did not want all that hassle.
In the end I had to confess to my husband about the loan and the credit card debt which has caused arguments. We are OK now but I am still extremely annoyed that the bank has caused all this. Have they done anything wrong?

TBF they probably did you a backhanded favour-secrets like that can be the road to ruin in relationships. At least now it's out in the open you won't have to sneak round corners-trying to get to the post before your husband so he doesn't find out.GE 36 *MFD may 2043

If I read the post correctly the bank did not divulge any information - wifey did.
I have no idea on a joint account why one party to an account could authorise a transfer though!0 -
Looks like I have come to the wrong website for help here. I thought I would get good advice of a financial matter not morally inspired confession encouragement.

When you applied for the loan, did you provide details of an alternative bank account for the money to be paid into? I'm assuming that you did, in which case the bank made a mistake by not following your instructions. This would probably give you cause to complain, but I doubt that any laws were broken .0 -
I had to tell him. What was I meant to say when he asked why there was £5K showing on his statement that he knows nothing about. I dont know why they would only let my husband move any money, santander have some very different rules to other banks.

I do wonder if this is a data protection issue. The OP did not apply for this loan in a joint fashion nor ask for the money to be paid into a joint account. By paying the money into the joint account they have "informed" the OP's DH that the money exists. I agree that you need to make a written complaint explaining the damage (if any) the bank has caused by depositing the money into the wrong account.Good Enough Club member number 27(2) AND I got me a stalkee!

What information did they divulge to your husband?
Also where does it says the loan funds are to go to on your loan agreement form?Best Regards
