It won't be on the visa slip (it hadn't happened then) but your bank T&C say it's payable so you ought to have known.
Your gripe is with the travel agent for not telling you that there might be a charge. They can't tell you there will be a charge as they are not expected to know the policies of every card issuer
The bank might pay it back on the grounds that it's easier and cheaper than fighting it - not because they are wrong.0
