Defaults listed on Equifax

  • I have the same registered on my credit file with Cahoot. I've spoken to them and they have confirmed that it is definitely not a default. They advised it is the amount that was due when I set up my arrangement with them and that once settled should be removed. Currently trying to get them to remove it (the debt has been paid in full) and they are due to call me back Monday to give me an update. I would suggest you speak to the company and request they correct it as well as contact Equifax. I was told that as per your screen shot it has to show as a big fat red D for it to be a default...
  • Thanks for your reply Mazza, I've contacted the company and raised an online dispute with Equifax so I'm hoping it gets sorted soon.

You could always send this template letter to the company concerned:
    Request for proof of Default

    Dear Sirs,

    Account No:

After recently obtaining a copy of my Credit File from the Credit Reference Agencies, I am concerned to note that your company has placed a "Default" notice against an alleged account I held with you.

Further to this, I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data.
    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit. Your obligation also extends to providing a statement of account. I enclose a £1 cheque to cover the statutory fee.

    2. Please also supply me with a signed, true certified copy of the original default notice.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
I would request that this data is provided to me within the next 14 days. If you are unable to provide this data then I require all adverse information to be removed completely, including any defaults that may have been applied. Please note that mere correction or amendment to the entry will not be acceptable.

    Yours faithfully

What was the account actually for?
If you've have not made a mistake, you've made nothing
  • Current account overdraft, when I was made redundant, no money was going in the account so I made a payment plan with them to repay o/s which they were fine with.

  • I still have a delinquent balance on my Equifax search for my Cahoot current account (which is paid in full and closed). Cahoot have come back to me again and have advised me:

The balance is something Cahoot cannot remove from the file and is something Equifax use for their systems. This should not effect your credit rating at all as the account shows as settled. If you are still worried about this being on your file, you will need to speak to Equifax and ask them if they can remove it.

I duly contacted Equifax who have told they only act on information given by the creditors and to file an online dispute. They did advise that a delinquent balance should reflect the amount outstanding (like an opening balance) at the time of entering an agreement of a payment plan with a creditor and should therefore be removed once the debt has been paid in full.

Both Equifax and Cahoot confirmed that it definitely was not a default. As well as the online dispute I've also written an official letter of complaint to Cahoot (about this and other issues) so hopefully may get somewhere soon!
  • I sure hope you do, quick enough putting them on aren't they, I opened an online dispute too around a month ago, still waiting to hear back from that :D
