Defaults listed on Equifax

Hi there,

How do I check if I have a default on my credit file, is it clearly stated or listed somewhere, I have one entry within the credit aggreements page that lists this

Default / Delinquent Balance £ 489

As far as I am aware this was part of a payment plan that I arranged with them but am confused as to whether its showing as a default or not. They did send me the standard 28 day letter (pay up or default added etc) which I had actually cleared the day before I received it but obviosly not before they sent it.

Just need to clear that up for piece of mind realy.

    Think you answered your own question by copy and pasting a default from you credit file.

    That's a default that's on your credit file.

    Im really annoyed as I paid it off within the 28 day notice, are they in the right to do this, any idea what, if anything I can do?

    Dont you have to recieve a letter from them to say that they are doing this?

    Have you checked all 3 files to see if they have done the same on the others also? I'd be writting a very strongly worded letter to them and disputing it with the credit reference agency.

  • So far all ive done is raise an online dispute about it, I haven't checked all the others no, oh boohoo I wouldn't be worried if I didn't know for a fact that its going to affect my job D:

    If I check all three and its on them all should I write to all three? I thought that this was all over and done with and I dont know where to start trying to dispute it /cry

    Do you work for a financial organisation? If it comes to their attention simply say it is an error and is in the process of being disputed and rectified. I wouldn't worry about it. They are in the wrong for doing this as you cleared the balance within the 28 days notice.

    I am currently in the process of (fingers crossed) getting made permanent at Lloyds so they will be looking at these details very soon as part of my application, I work there on a temp basis at the mo. your words calm me, thanks very much. I guess i'll wait to see what comes of the online dispute and take it fromt here.

    You could always send this template letter to the company concerned:
    Request for proof of Default

    Dear Sirs,

    Account No:

    After recently obtaining a copy of my Credit File from the Credit Reference Agencies, I am concerned to note that your company has placed a "Default" notice against an alleged account I held with you.

    Further to this, I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data.
    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit. Your obligation also extends to providing a statement of account. I enclose a £1 cheque to cover the statutory fee.

    2. Please also supply me with a signed, true certified copy of the original default notice.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
    I would request that this data is provided to me within the next 14 days. If you are unable to provide this data then I require all adverse information to be removed completely, including any defaults that may have been applied. Please note that mere correction or amendment to the entry will not be acceptable.

  • I'm a tad confused about all this default business, I've sent off the letter and they've presented my cheque for £1 yesterday and still awaiting reply but I've come accross another thread that shows a default as this;

    My credit file has nothing like the above on it, it looks like this

    I only posted the wording that is above all the coloured squares (Default / Delinquent Balance £489) in my post above and am now really confused! I know im jumping the gun and I am waiting for them to reply to the letter that was given to me above but I can't stop this going around in my head!

    On another note I would have aspected to see the above as "arranged to pay" as in March 2010 I made an agreement to pay them back £40 pcm and they were happy with that and then I paid of the remainder in december 2010 to clear it early, are the within their rights to do the 3 payments late as above instead of "arranged to pay" as I feel it is misleading.
