Didn't pass residence test! Help!

    Forgot to add. Another way to reduce cost of rent (I know this may sound really obvious) is to reduce the number of bedrooms & go with the bare minimum. It would be a squeeze & not a great situation but maybe getting a 2 bedroom. Little ones in with mum. Older kids in 2nd bedroom. Or mum sleeps in livingroom kids have both rooms or mum has her own room, kids sleep in 2nd room in bunk beds. Many, many families in the UK have to this & though not an ideal situation it may be your answer. Does your mum/family get any other help in terms of benefits? You really do need to stretch these. As I said before reduce all outgoings. Clothes second hand, food from markets or heavily reduced. Although living in London is expensive (rent wise) you are very lucky to get cheap public transport to places (& kids get a free oyster card), shops are usually only a walk away & also because theres lots of choice a bargain can usually be had

    Please people get real and stop being so "Nationalistic" Why the hell should not the OP receive the same benefits as anyone else in this country- OP is an EU citizen and we are effectively One Nation.
    Come on we have all done it and claimed benefits in another EU nation- In the 80's I was in the forces in based in Germany claiming German child allowance because it was more than the UK.

    Surely if the OP came here in May 2005 the 5 yr residency test would apply.

    Well, I doubt that's true for a start!

    If you think that a British citizen can just move to another EU country and claim benefits, then you're sadly mistaken. In fact, most other EU countries are far stricter than the UK as their benefits systems are often based on contributions (to their own country's system), whereas much of the UK benefits system is based on residence.

    As I said earlier it isnt the fact that the OP is being forced out of the country & deported into a war torn developing country, they just cant afford the rent & are not entitled to the rent being paid for by the state. There are many people who live here who dont earn very much & find it difficult to pay the rent. What usually happens is that they try & cut back on spending in lots of different ways (look at the old style board) & move into cheaper accomodation (London is one of the most expensive cities to live in). They take control & do things themselves to be able to afford things. They look at their budget. This would have been a bit better rather than just looking at housing benefit & what the state can handout. Its not beyond their contol. They are still allowed to live here.
  • I really don't feel sorry for the op. They could easily move out of London to somewhere much cheaper but they choose not to. They could also move back to Germany and be entitled to benefits galore, but they choose not to.

    I would love to live in London but I can't afford to so I don't. You don't have a 'right' to live anywhere you want

    I am amazed that people can move to a foreign country and expect to live for free at the expense of that country's working, tax paying citizens.
    From your initial post, it looks like your 'dad' was only working for one year out of the six, the rest of the time, we have been paying for seven of you to live for free in London!!!

    It just seems to me absurd to think people think this scenario is ok. It's not nationalistic in the slightest - I wouldn't expect anyone from anywhere to expect handouts to stay in a country that is not their own for free and that includes Brits, for example, that become unemployed in Spain or wherever. I would assume they would come home rather than attempting to live off the Spanish state (not that the Spanish state would entertain this as easily as us!).

    Maybe look into if the German Government can offer you any help with your English rent and Council Tax.............

    And I don't think there is any call to be abusive - I'm no more an idiot than you.

    And I think everyone should have the right to live in a safe environment and I think everyone should have the right to live wherever they want. I do not, however, think anyone should have the right to live for free at the expense of others who do have to work. There are many university aged students who cannot afford to go to university.They are working, to support themselves, to support their family in need.I would prefer to live in London, not pay Council Tax and not pay London rate rents. Doesn't mean I come kicking and screaming on MSE when people tell me, sorry love, it's not going to happen. Nobody is making you leave the country, so just pay your way and the problem will go away.
