Been threated with police action over £4.50

Hi guys

Hoping someone can help me as I'm getting myself into a right state. Basically I sold a lady a coat for £1.77 and a 99p top on ebay a few weeks ago. She didn't ask for a combined invoice (admit I should've probably given her a partial refund on shipping without asking) but think it all cam to about £8. Anyway a few days later she sent me a really nasty email about how the coat was damaged (I'm sure it wasn't) anyway I asked her to return recorded to my address and I'd give her a full refund upon receipt. I checked her other feedback and she gives out loads of negs and in one instance the seller never received their item back.

Anyway low and behold I didn't get my items back just a load of abuse. Ended up giving her a refund for the £8ish as I really couldn't be bothered going round in circles but said I would refund the £4.50 she claims she spent on returning the parcel as I didn't have it. I asked for tracking number about 5 times and she ignored.

Now I received an email this morning telling me that she'd reported me to ebay and they'd told her to contact the police (which she says she has) as it's fraud- she also reckons Royal Mail have told her I have the parcel- which I don't!

I really don't know whether to ignore her or just wait for the police to knock on my door? What should I do? I've never been in any trouble with the police before and had 100% feedback with Ebay up to now!

    Don't panic, just ignore her and block her from buying things from you in the future.

    1. She hasn't contacted the Police. They are not going to waste time on an allegation of Fraud for £4.50. :rotfl:

    2. It's not fraud. Distance selling regulations only apply if she contacted you to tell you she was returning the items within 7 days of the sale and only if you are a business.

    3. You don't have to refund until you get the item back and it's up to the buyer to provide tracking information proving you got the item back not the seller.

    4. If you're not a business seller it's not fraud even if you got the returned item because only business sellers have to refund return postage (I think).

    5. Even if you were in the wrong the Police would not doubt view it as a civil matter to be dealt with in the small claims court.

    Thats total rubbish. Ebay would never say contact the police over such a trivial amount and I can tell you now that the police will have nothing to do with it and tell her it is a civil matter if in fact she really did speak to them.

    I would suggest you no longer respond to her and contact ebay immediately, either by phone or email. Tell them everything and if you have messages or emails from her that are threatening make ebay aware of them. Also point out the other feedbacks she has left and they may be able to see a pattern.

    From the sounds of it she is a nightmare buyer who should be banned!

    She sounds a right wind up mechant. Insist on a proof of postage as without this she has no claim whatsoever.

    Totally agree just block her - she sounds like a scammer that has worked out a very clever way of getting stuff for free off Ebay. I think there are loads like that. Fred7777 is right - only business sellers have to refund postage etc. And Royal Mail wouldn't tell her you have the parcel unless they had a sig to say they had delivered it. If she won't give you the tracking number tell her to go do one. She's trying it on with you because you refunded so quickly, she probably thinks she will get another £4.50 out of you to shut her up. I'd send an email back telling her that you are going to contact the police because you believe she is trying to con you out of money - she either gives you the tracking number of the parcel or you too will take further action. Also speak with Ebay - they will be able to see a pattern, you may even get her banned which would save other sellers the hassle you have gone through.

    Just ignore her, no one is going to take her seriously until she returns the items to you and provides proof of the costs. She's just being ridiculous.

    I agree with mmilly contact ebay and get them to sort this out hopefully once they investiage the buyer could get banned.

    I would be tempted to send another e-mail:

    Dear buyer,

    "Following your recent correspondance, I have just returned from a visit to my local police station to seek their advice, and after I had given them your details to enable them to check up on the progress of the case, they could not find anything relating to your complaint.
    Could you please advise me of the incident number issued to you by the police, and also the name of the person that you spoke to, as the investigative officer I contacted wishes to make sure that this matter has not been overlooked.

    Could you also send me details of the ebay representative that advised you to contact the police, as I was also asked for this information"


    Send that, and I doubt if you will hear anything else from them.

    TBH I would ignore them. Buyer is full of hot air & just trying to use bully boys tactics, she has a history of doing this from what you say. People like that do p me off & get dealt with accordingly.
