Selling a car on ebay (no MOT)

    Shaun, no disrespect but thats bollox.

    An Mot is not proof that the car is roadworthy, only that it was on the day of the test. OP you are fine with what you put, if you wanted to you could add a note confirming that the vehicle would in your oipinion make it to a local testing station straight from your house etc. this is completely legal as long as the test is pre booked, so if the old bill pull the punter and ring the mot station they confirm that the car is booked in for test, ergo legal (unless obvious defect like bald tyres etc)

    From the opening post.
    It is an MOT failure.

    It failed an MOT, so on that day you admit that it was unroadworthy. No work has since been carried out to rectify the fault, so it must still be unroadworthy.

    So what do you think would happen if the car was taken straight to an MOT station for another test?
    The first thing the testing station would do would be to check the records for the car, find that it had recently failed and see that the fault had not be fixed.

    so we emailed VOSA with this question and this is their response:

    "An MOT certificate is valid until its expiry date. However if your vehicle fails a test before this date and you do not rectify the defects then you are driving an unroadworthy vehicle which is an offence."

    You should definitely get rid of this bit, and change it to clearly state that there is no MOT and the car is not roadworthy at present.

    It is an offence to drive an unsafe vehicle, but more importantly, it is also an offence to allow someone else to drive an unsafe vehicle.
    It's also now illegal to sell an unroadworthy vehicle, unless you make it perfectly clear that this is the case and that it shouldn't be driven until it has been repaired.

    A couple of queries I now have:

    Once the car is sold though, I cannot physically stop the buyer doing what they want to do with their car. So, as long as I get all the paperwork present and correct at the time of sale, all responsibility for the car will pass to the buyer.

    I have made it clear that it is an MOT failure and they need to arrange collection. But I also put the note in about driving the car, as the car is still driveable, ie. the car could be an MOT failure that is not driveable, but I added the further note that if they choose to drive it, they are doing so at their own risk.

    I understand that it is an offence to drive a vehicle without an MOT, but as others have mentioned the car could be used for any offence, they could buy it and go straight off to rob a bank in it.

    The purpose of this thread is just to make sure that I am personally not liable for the car once it goes really, that I avoid any obvious scams, and also that I do everything I am supposed to do when selling the car.

  • When i sold my bora on ebay (spares/repairs) i cancelled the insurance as soon as the buyer picked it up,as all the docs were signed,etc,it was no longer my problem. Do not accept paypal as already recomended and be prepared for NPB's wasting your time and advise potential buyers to come and inspect the car. Mine didnt - got a 'mate' to pick it up on a low loader and started harrasing me that it wasnt as discribed/expected and the police got involved :( hopefully you will get an honest buyer who will allow a smooth transaction.

    If the buyer is paying cash, I would call the insurance company as soon as the car has been collected.
    Also make sure that you get the buyer to sign the appropriate part of the V5, and ensure that you get this sent off immediately.

    It would also be worth printing out an invoice of some sort and getting the buyer to sign it. Something along the line of:
    "I hereby accept delivery of vehicle XXX XXX. I understand that it has no current MOT and will require rectification work carried out before it is considered roadworthy"

    Make sure this has the date and time on it.
    Probably overkill, but for the few minutes it would take to do, it may be worth considering.
