Selling a car on ebay (no MOT)

Hi,
I am selling a car on ebay. It is an MOT failure.
I have listed it as accurately as I could, stating the reason for MOT failure. Posted several pictures of the car etc.
As I have never sold a car via ebay before, I was just wondering what are the main things I should be looking out for.
Eg, I don't want somebody to buy the car, then turn up in a week or two demanding their cash back, or having a paypal case opened against me, or being scammed, etc.

Im not too clued up on this but...dont accept money through paypal or any other way, just get cash on collection. Dont even offer paypal in your description.

1. Dont accept Paypal payment - cash only.
2. When they come to collect, have a printed receipt ready for your details, their details and the car details. State on the receipt "Sold as seen".
3. Do the V5 properly - send off your bit ASAP.
4. Make sure you hand over all docs to the buyer inc the MOT failure docs.
There really is no comeback if everything is documented, especially on a MOT failure. It's not like a car with an MOT and a load of hidden problems.
Be prepared for the timewasters as well and just shrug them off (when I first sold a car on ebay I got pretty annoyed at them, but it's part and parcel unfortunately).0 -

Correct. Motors is one category on eBay where you can UNTICK Paypal and only have Cash ticked :-)0 -
I didn't know you could untick paypal, have ticked cash on collection though and stated that this is the preferred method of payment in the text.
I have also put a note about them arranging collection, or driving at own risk as it has no MOT. Basically I don't want them to turn up and want to drive it away, but if they get caught or the car has any problems, expect the responsibility to fall back on me. The car does drive and I would be confident that there wouldn't actually be any problem, but that isn't the point really.
I was also worried as it is an MOT failure, they would take it away and then possibly decide they don't want to do the work required after all, or it costs them more than expected and they try to claim back off me or return the car. But I have listed the exact faults per the MOT, so hopefully I will be well covered, just in case there are any problems.

With regards to responsibility for driving away - they SHOULD be getting it towed or be driving it directly to a garage for repair/retest. However, that is their responsibility.
Make sure the TIME of exchange is noted on the receipts you both sign, so that there can be no argument about who owns the car if they get pulled over after driving away with it.0 -
If you auction really does say "drive away at own risk" I would be inclined to remove it as some people would see that as confirmation that it was okay to do and if anything was to happen, you might be considered as inciting someone to break the law.

I sold a car on e-bay about 12 months ago, i didnt get chance to send the v5 off straight away (due to working away i forgot to take it with me to post!!!) i sent it 2 weeks later and 3 days after i sent it off i had a knock at the door, it was the police telling me the car was involved in an armed robbery!!!!! it took me ages to prove i no longer owned the car!! so please be very careful when selling a car on e-bay0

Just why you should always do a decent receipt & both sign/date/time it.0 -
And that could happen no matter which medium you used to sell.
Also, can you imagine a policeman's response if you told him someone had said it was ok to drive this car?0 -

You should definitely get rid of this bit, and change it to clearly state that there is no MOT and the car is not roadworthy at present.
It is an offence to drive an unsafe vehicle, but more importantly, it is also an offence to allow someone else to drive an unsafe vehicle.
It's also now illegal to sell an unroadworthy vehicle, unless you make it perfectly clear that this is the case and that it shouldn't be driven until it has been repaired.0
