I told the advisor that I've been mis-sold a product but she couldn't care less and said they are free to change the tariff and apparently this is stated in the terms and conditions?

I'm sure I won't be the only person in this situation - its been approx 9 months since the iphone 4 has launched and many people will be downgrading around now.

I know it's not what you want to hear but it's the same situation, the terms of the CURRENT contracts have changed. You were not mis sold as at the time the advisor was correct, and your terms have not been changed.

You an either continue on the current contract or change contracts to downgrade your bill. As has been noted if you change down you are then bound by the contracts in place at this moment in time and you are limited in what you can down grade to. IN this case it's the £37 pcm contract.

O2 are keeping the contract you have with its terms in place until you change off it, but it's become a closed tarrif in that no-one new can move to it.

Speak to someone on the online chat , preferably on the weekend, they are a lot more flexible than the people on the phone.

I called to downgrade today from my £40 to the £35 tariff and I was told the tariffs have now changed and so i'll have to pay £37 instead now.

    £35/(1+0.175)*(0.2-0.175)=75p, not £2

For the Q1 2011 tariffs O2 have rounded up the prices to the nearest 50p or £1 so you end up with prices like £31 and if you have a data bolt-on they're now charged at £3, £6 or £10 so you get prices like £37. At the end of the day things are constantly changing and if you want to change the change the contract you're on you'll have to move to their new T&C, you can't expect to get the best of both worlds.

I agree with the original poster here.

O2 should explicitly state that you can only move down 1 or 2 tariffs after month 9 in an iphone contract as it's misleading.

They don't want people moving down to say for example £20 a month tariffs as it wouldn't be beneficial to them as they probably pay apple £300 per handset.

I've downgraded my iphone 4 to the £40 month tariff. After my contract is up in 7 months I shall be selling my iphone 4 and getting the new iphone 5 (which is likely to be released between September and December) and going sim only with giff gaff.

This way there is no long term contract, I can chop and change my tariff to suit my needs and it works out cheaper monthly.
