Assured shorthold tenancy agreement help

I signed a assured shorthold tenancy agreement (unfurnished) on 22nd january 2010. the term states 12 month. which would mean 22nd january 2011. I presume it then goes into a rolling contract month by month?

My question is.. how much notice do I need to give to move, and how do I work out what I owe when?

The rent bit states... "£500 for each rent payable in advance on the 30 day of each such rental period to be paid by way of direct debit to the landlords bank account". I have read the entire tenancy agreement, but nothing i stated about leaving or giving notice?

I paid my last rent payment on the 22nd of January.

    On what date did the tenancy start? Legally, you have to give at least one months notice ending on the final day of a rental period.

    For example: if the tenancy started on the 23 Jan 2010 (meaning the fixed period ended on the 22 Jan 2011 as you imply but your dates of confused) then you would have to give notice on or before the 22 Mar 2011 to leave on the 22 April 2011.

    You can always approach the LL to see if they would agree different terms to suit your needs but they are under no obligation to agree.

    1 month coinciding with a rent day. If you were to give notice today then the earliest you could leave is 21st April

    This would mean your fixed term was from the 22 Jan 2010 to the 21st Jan 2011 (and not as you said in your OP).

    In which case, you need to issue notice on or before the 21st Mar 2011 to leave on the 21st April 2011.
  • N79 tbh I feel really guilty and mean. A few weeks ago I got a loan to pay half towards an electric shower.. he asked me am I def going to be staying a while before he agreed to pay half towards. And agreed because I applied to warmfront for loft insulation and new heating and boiler. The loft insulation has been done, but they said May for the heating. I am presuming if I now move he will no longer get the heating? A relative is renting out a house for same price but with garden and driveway.. and with bigger bedrooms.

    End on the last day of a rental period - the rent day is irrelevant (the two dates may be the same but they don't have to be). This is important in this instance as the OP appears to have paid their rent a day "late" throughout the tenancy.

    You are breaking your word so you probably should feel a little guilty but legally your are not breaking any rules. People's circumstances do change.

    If I was your LL then I would have got you to sign a new fixed term in return for the "upgrade" to stop you doing this (although in this day and age provision of a shower is hardly an "upgrade" in anything but the most basic accommodation). Your LL didn't - and it looks like it may cost them. If its any consolation to your guilt, the electric shower will improve the marketability for the property and may even allow the LL to command a higher rent (assuming we are not in the LHA market here).

    Assuming you leave on the 21st of April it would be the payment due on the 21st March (which I guess you will pay a day "late" on the 22nd March as that is the agreement you have with the LL).

    The house I will be moving to is owned by ex mil.. so its a house I know wont have damp etc.. as I lived there for a few years with my now ex husband.
    So I am guessing my April rent can go to new house for 1 months rent in advance? Sorry if I do no make sense anywhere along the lines.. I am very sleep deprived lol. Feel free to ask any questions you feel may help with your replies.

    how do you pay your rent . Do you claim housing benefit if this is ex mother in law you may have issue with getting it , check that out before you give notice in here
