***URGENT*** - Courts messed up Divorce stuff

thats correct, cant prove delivery.... Am just assuming it would have been delivered to the courts as the post was:
A: Collected by Royal Mail from the office
B: The office location is Gloucester
C: The Gloucester county court is the court dealing with the case.
And no, the return papers were not sent recorded delivery or special delivery as figured it would'nt need to be, idea of paying for post is it actually gets there!
or gets there within a week 1st class.....
I cant say who lost the paperwork (royal mail or courts), just more into how i speed things up, dont have to worry about insurance and all that, just need a way of getting the newly signed papers (hopefully the ex will get them tomorrow if they send out the forms today), so i can get it back to the court on Thursday and hopefully in the judges 'Inbox' by next week, so he/she can take a week or 2 to declare it....
Oh, and sending 'recorded' mail to the courts would prove it got there, but it would never help as the dept that deals with matrimonial would'nt be the first people to open the letter..... as said, more interested to know if there are ways of speeding things up!
And yes, very brave booking a wedding and party and guests to vegas before getting the DA!
And also, i wrote it in a way you think its me for the divorce... but its not, its my lady whose doing the divorce, just easier to write it so it looks as if its me

No, but it would have proved who first received the letter, giving you a starting point, and it would prove the letter was actually in the building.
With that information they would have been more likley to be helpful and look for your paperwork, instead they are probably making the assumption that they never received it so won't waste their time looking.
For future reference having post collected from your office is no safer than putting it in a post box.Accept your past without regret, handle your present with confidence and face your future without fear0 -
1. Your "lady" should have checked with the courts what the likely timescales were and not assumed; and
2. Why should she get "speeded up" to the detriment of anyone else ie queue jumping?
You were a bit foolish having such tight timescales; that said I hope the paperwork does come through on time as Las Vegas is a wonderful wedding venue. :beer:0 -

Had you been able to prove that the court had received the paperwork, they would have fast tracked any replacement papers. However, that is not the case, so you will go to the back of the queue.Gone ... or have I?0 -
Recorded might not have guaranteed the papers would have got to the right place, but the signature could have proved that they were lost in the courts. They could then be asked to assist with making the replacement papers arrive and be dealt with a bit quicker, however there is no proof they ever got there (no proof they were sent in the eyes of the court) so there's no burden on them to offer extra help.0

My other half spoke to the lady in the courts this morning. The lady said its possible the papers are lost or mis-laid in there court for busy they were end of jan and first 2 weeks of Feb...... and that my partner isn't the only person to have made enquires about paperwork not being actioned, etc etc....
Maybe i should have worded my post differently and said is there a way of writing in a polite way to speed things up... ? which i plan on doing...
Now, for the peeps who get off on posting non helpful comments.
1: Compared to someone who gets an assisted divorce on legal aid, i expect that i jump the queue. Why ? Cos i pay the full cost simply, thats why.
2: Lemmings - Wanna live your life mundane and not be prepared to take a gamble now and then, fair play, each to there own. But we live life to full, vibrant and entertaining, and add pressure with pleasure to create a happy meduim and risk with great results.
3: Timescales: None contested 2yr sep divorces result in the DA after 4 months, maybe 4 1/2 months..... She could'nt proceed until end of Dec, forms handed in 10th Jan, that leaves enough time with the timescale given by solicitors as well as the court in question. (asking timescales, not using solicitor)
4: Post - Although its taking a beating, i still have faith in the royal mail, and hope that when i send stuff through the post it gets there.... using normal franked post as well as stamps, so therefore, would'nt require a simple form posted in the same area to go walk-about.....
So now thats out of the way, i'll write a nice letter, despite the lady at the courts already saying it will be fast-tracked to the judge
(but told that it sits with him/her for 1 to 2 weeks, then he declares and then it comes back to the processing dept...) so i guess my letter would be aimed for the judge...
And thank you pigpen, 3 months sounds ok to me

I used to work in the Courts
And anyone, solicitor, court clerk, someone who has been there, would say that to book a wedding without the decree absolute was insane
The 'should take' times, the times that the targets used to be, were ten working days, ie a fortnight, from receipt of the docs to putting it in front of the judge, then another ten working days between it coming back from the judge and dealing with the papers.
That is if the section is working to target and not hammered by the understaffing and underresourcing that was so endemic in my day.
As for queue jumping - first come, first served, regardless. It means that justice is equally applied, which many think is a good thing.
The volume of matrimonial work that goes through the courts is huge. I worked in one of the smallest in the country when I did divorce work and I issued over one thousand in under a year - that is just issued and not any other part of the divorce process which takes time.
And heaven forfend if your application is held up by a spate of injunctions under Family Law, usually dealt with by the same section. After all, why shouldn't a man or woman continue to get battered as long as you get your June wedding?
In the circumstances you describe I would (and did!) do everything I could to get things through, but please do not expect too much from the court staff who usually do their best. You are not the only pebble on the beach.Ankh Morpork Sunshine Sanctuary for Sick Dragons - don't let my flame go out!0 -
Cant queue jump if i'm already in the queue (10th Jan)
And yeah, could'nt give a toss about anyone else in the queue. This is a dog eat dog world, spend your time worrying about others knowing nothing comes of it, u get nowhere.
As to your 'should times', your right, thats what we were told.... hence why the lady in the court will try and move things along as were already stamped in for the 10th Jan.... so the court staff (not judge) will do there best as already said.
Anyway, case closed, go post negative stuff on other peoples threads..0 -
