i phoned up black horse this month and asked to delay a payment, when i was told that the contract i signed had stated that i could only delay by a day ect ect. So with that i dug out my agreement and the small print on it is ridiculous! iv been sold something i wasnt aware was on there, nor did i no what id got myself into or how to get myself out of this agreement!

What made you think you would be able to delay payment?

I think the old saying 'act in haste, repent at leisure' applies here

im not being funny yeh but you lot havent read it properly! I WAS NEVER TOLD I WAS FILLING IN A FORM FOR CAR FINANCE! I WAS TOLD IT WAS JUST A CHECK! AND THEN THE GUY DIDNT GIVE ME A CHANCE TO READ THROUGH THE PAPER WORK!!!!!!!!

yet my friend went the other week to another car garage and was given 30 minutes to read through it all

i think you are all being out of order; i posted this for some advice not for sarcastic stupidity from people that were ment to be responsible adults.

my mum said this site would give me advice because there are some knowledgeable people out there, maybe i havent made my post clear enough but when i have told other people about this in face they agree i was mis sold!!!!!!!!!!!

I'm not being funny but I did manage to read your post and even managed to understand it. However did the alarm bells not ring when you were given paperwork to take away (you've read your agreement now but why not then?)? Or when you were asked to arrange insurance? Or when you were asked for a deposit? Or when you actually went back to collect a car that you clearly didn't want?????????????????

Oh but again it's someone elses fault. Have you not got a tongue????

You have been clued up by "us lot" but you didn't like the answers!!!

Who were the other people that you told to face? What was their area of expertise?

Ah there's that word again.....'mis-sold'.....the catch all term used by a whole generation as a means of justifying their own stupidity.

So you didnt realise you were filling in a form for car finance, yet you drove away in a car clearly not having paid for the purchase price in cash. How did you think the dealer had been paid? Magic beans?

If you needed your mum to point you in the direction of MSE then why the hell did you not take her to the car dealer with you, as you clearly shouldn't be let out of her sight.

Sorry if that sounded harsh, but someone needs to shake some reality into you, and it aint going to be Martin Lewis and his reassuring smile at the top of this page.

Doesn't change the fact that you didn't read what you were asked to sign. If you had, you would have known it was a finance agreement!

Also, how could you not know you were signing to get credit? Do you think they were going to just let you drive away the car?

you even state in the orginal post

we went through all the completation of a form for finance with black horse,

seems to imply you knew what was going on
  • Hi OP,

I know it looks like people are having a go but honestly it is just that every day naive people come on this forum having made bad judgements and decisions and deny that they are responsible for them. The people are right. If you though you were just getting a quote or finding out if you might be approved for finance you should not have signed anything, you definately should not have signed anything without demanding to read it first, if they refuse to give you a copy to read so you know what you are getting then that is the first sign that you need to say goodbye and walk away.

Also why have you only just read your paperwork now, why did you not read it when you got it especially if you say you weren't told anything at the time this is surely the first thing you should have done, you would probably have been able to cancel at that point. Unless these other people that you spoke to happen to also be consumer law solicitors then chances are they are just telling you what you want to hear. Do you have proof that you weren't given the chance to read the paperwork?

I don't mean to sound like I too am having a go but I believe you are responsible for this and will not find a simple and easy way out and neither should you, you wanted a car, they got you the money to get the car, you have the car, you didn't demand to read everything before signing and you didn't check your paperwork when you did get it you could have said no at any point and walked away. how is any of this anyones fault but yours. I'm sorry if you don't agree but this is just the way i see it.

I was with my OH when he went to part ex his car and refinance, we asked lots of questions about monthly costs apr, interest, charges for repaying early, total borrowing costs, read all the paperwork made sure it tallied with what we were told and then signed it.

You are trying to argue that it was missold because you weren't given all this but you should have demanded it and they will have to provide it or you should have walked if you weren't happy.

If I was you I would consider this experince one to learn from so that you never make a similar mistake again.

Clearly the garage is at fault for not realising that the OP was out, without mum's permission and should have been practising times tables before school.

Didn't it make you think when they handed you the keys to the car LOL

So you thought they were just carrying out a credit check on you, but then they gave you the car keys, you drove away and were happy to pay the monthly amount until now.

Did it not dawn on you that you'd agreed to buy the car? Did you think they'd lent you the car for an extended test drive?
