Hi
I recently went for my ATOS medical,Ive been claiming Income support and sickness benefit long term(mental health issues).
Ive explained bit more in previous post
https://forums.moneysavingexpert.com/discussion/3077942
What has really annoyed me more than anything is they have ticked no for some of the questions which I was asked and I said I had these problems and its like ive just been ignored, everyting I said.
Anyway,Im appealing agianst the decision, could anyone please advise me how to go about this please? What should I do first on Monday and who should I contact. Also is there anyway I could get a copy of the notes that were taken during the examination,as I feel like they think Im a liar or something, bloody fools:mad:
Would appreciate your help,thanks

I told you the procedure yesterday, you download a GL24 and fill it in and that lodges your appeal when the DWP recieve it but they dont have to accept the appeal, if they do you need a new fit note and you will need to keep supplying fit notes until told otherwise.
You will recieve the notes in the appeal pack along with a copy of your IB50, the change to ESA begins in the main phase tomorrow and I dont know if that will have any impact on your appeal, the MH discriptors also change tomorrow to make ESA even harder to get.
The complaint that you have posted above dont count for anything, they can record what they want and as I said yesterday your chances of getting past the ESA medical are very, very slim if you have failed the IB medical so it would be a good idea to think through what you will do if/when you fail to be entitled to sickness benefits.0 -
I appealed against the same thing a couple of years ago, but still got turned down, I had to accept the decision and find work that I could do, rather than dwell on what I couldnt do, it was hard, and I agree about how they wrote down different answers to which I gave, but unfortunately, and this is my opinion, they were just determined to get me off of IB, no matter what I said, the medical was a complete farce, and I still think I was cheated (if only because of what I said, they twisted, ignored and just wrote the opposite) but as I said, I had to accept it, as I knew I had no chance of winning, good luck with your appeal, but prepare for the worst. People with mental health probs are easy targets, and they know it.what goes around, comes around...........0

Could I ask, are you still in work?Gone ... or have I?0 -
Yes. I managed to find a job working from home, and have been working since 2009, as I said to the OP, try to find something which they can do, rather than dwell over what they cant do, its better in the long run all round.what goes around, comes around...........0
