Think my time has come

A rumour started spreading today that a few people are going to be paid of, there is only 6 of us, when the boss was tackled he said it was none of our business so we can take that as a yes its true, I have had little to no work since Christmas even though I am 1 of the longest there, the boss started 2 new guys after Christmas and it was them who started the rumour, they are friendly with the boss so it won't be them going or the boss wouldn't have told them.

Legally where do I stand here? What rights do I have?

  • That's quite insulting for your boss to turn around and tell you to MYOB isn't it! I wouldn't listen to a word your colleagues are saying, personally I believe rumours are always best ignored.

    Really, I wouldn't worry yourself over this. Right now you just have to wait until an official announcement is made, ignoring the pr!cks that are making life a bit difficult for you.

    I remember several years ago when I worked in a small shop, We started receiving phonecalls from people looking application forms, I then received a phonecall from the job centre asking if I wanted the listing put on for another week, There was only enough work for me in the shop, I again asked the boss who told me it was no of my business, the dirty !!!!!! was listing my own job under my nose, I left soon after.

    I suspect you are right. It looks like the writing on the wall is there.

    It IS very much your business - because it affects your income!

    Time to say nowt/do whatever work you ARE given at work and make preparations.

    First off - don't forget that capital limit of £6,000 that is the maximum allowed by the DWP if people claim means-tested benefit. That means savings and redundancy payout and even the money in purse/wallet.

    If you have more than that - then buy anything you need/do any work you need doing on the house/get well stocked-up with food, etc NOW (ie before you get told that you are redundant by him) - but keeping enough money by you (including any redundancy payout you are due for) to allow for the fact there might well be a few weeks delay in receiving benefit (assuming you cant find another job to walk straight into - though lets hope you will be lucky with that).

    Check how much redundancy money you are entitled to.

    Check how much notice you are entitled to.

    Check out the state of play in your local "job market". It depends on how much redundancy money you are due for whether you "dive straight out" to another job (if you can find one) or hold out and wait to actually be made redundant and serve out your notice.
  • Well I am there 5 years and am 30, its only stat redundancy so I presume I am due 5 weeks pay correct? However I suspect getting this will be an issue, they are slippery, I wouldn't be surprised if I got some sort of gross misconduct or something to avoid the payout
  • plus any accrued holiday pay for the year that you have not yet taken or been paid for.

    also redundancy pay differs with your age if memory serves me right those who are under 21 during there service will only get .5 of a week for each year of service and those over 41 get 1.5 weeks for each year of service.

    Verbal contracts arent always as bad as people think.

    You still have a contract just instead of being express (written as most contracts are) its implied terms through custom and practice.

    For something to be implied through custom and practice i believe you need to have worked it for at least 13 weeks. ie if you were usually paid a xmas bonus and werent this year, you could argue its an implied term.

    I suggest you contact CAB and discuss it with them. I had to do this myself recently and the lady i spoke to was really helpful and made me aware of a few other options that i was unaware of. AFAIK, unless you request them not to, they will keep a record of your inquiry - which may serve as useful if they do try to fire you instead of making you redundant.

  • You are correct in that you are entitled to 5 weeks' redundancy pay for completing 5 years service at the age of 30. You will get either your weekly amount or £400 per week as that it the legal requirement. This is tax free.

    On top of that you are entitled to any outstanding holiday pay and, unless workin it, your notice pay. Notice would be a minimum of 5 weeks of your pay. This is not capped but is taxable.

    If your Company decides on redundancy, and there are 6-8 of you doing the same job, then they need to put you all in a "selection pool". You must be advised of the criteria for selection and, if selected for redundancy, be able to challenge the scoring on the selection.

    As there are less than 20 post to be redundant, then there is no legal minimum consultation period. However, there must be consultation on ways in which to avoid or minimise the number of posts affected.

    With 5 years service that a minimum of 5 weeks notice and 5 weeks redundancy(pay capped at £400) so max stat payout is £2k.
