Tenant lied - has a crime been committed?

  • Definitely try to catch him out by asking for information in writing. As stated above just say it's for warranty purposes.

    If this cooker was brand-new two months ago how long has this shyster been in the property?

    I have it in an email, but I can try to get it in writing also. I have already been around and inspected the cooker, and so have actually compared the serial number.

    He has only been in the flat two months. I replaced the cooker and dishwasher just before he moved in.

    What makes you think it is a gas cooker, evoke? No information. Good point if it is, though.

    Has a crime been commited? Simple answer (assuming all the info you provided is correct) - yes. Attempted fraud.

    However you'll need evidence if you want to pursue the criminal element. At the least you need him to put his claim in writing. Ideally some kind of (presumably false) receipt for the 'new' cooker. You'll also need to be able to provide evidence of the original serial number, to prove no new cooker was actually purchased.

    Once you have all that, the police should be interested.

    But as others have said, since you are not out of pocket, is it worth it? To be honest, my priority would be to get rid of this untrustworthy tenant. So yes, ask for the written documentation, but then use this to support your request that he surrendor his contract within the week. Make the alternative clear - (but not in writing of course).

    Oh, and as for the request for re-imbursement, putting aside the fraud, the tenant has not followed correct procedure for getting repairs/replacement done so you would have no obligation to pay for a new cooker anyway. Did he write to you first? Did he provide 3 quotes for new cooker? Is there any evidence (ie a professional electrician/gasSafe engineer's report) that the old cooker was beyond repair? Has he kept the original faulty cooker to show you and for you decide whether to dispose of or keep for yourself? ........

  • Well, I think you should expect another demand for "replacing" the dishwasher at any moment.

    I would play along with this berk's scheme without supplying any information to them, especially the fact that this cooker has a serial number on it. The tenant patently doesn't know that right now. I wonder how he's going to explain what happened to the "old" one?

    I suspect that they've drafted a "receipt" for this replacement cooker in Word. Ask to see the "original" receipt rather than a scanned or photocopied one for the moment.

    You could have all sorts of fun with this idiot before revealing that you know what they're up to and can prove it.

    A few days ago I was contacted by my tenant, claiming that there had been a problem with the cooker (which was brand new 2 months ago) in the flat, that he had not been able to get in touch with me, and that he had had to get the cooker replaced at his own expense.

    The thing is, aside from whether he actually tried to contact me or whether I am even liable to replace the cooker, I have since been around to the flat and inspected the cooker, and I know for a fact that it is exactly the same cooker (because I have compared the serial number on it).

    I have asked him for receipts and he says that he can provide them, but has not yet done so.

    My question is whether what he has broken the law, and whether it matters that I have not handed over any money to him.

    If he has broken the law, is this something that the police would get involved with?

    I am very unhappy that he has done this, and I want to make sure that he doesn't get away with it.


    Has he 'upgraded' it?

    I've looked on Rightmove and seen that most of the included appliances on rentals are cheap and nasty (sorry) and the kind that have the grill built in to the oven and takes about 5 years to cook cheese on toast.

    This has scuppered many a move for me... if I wanted a nasty beko oven I'd have bought one!

    I've evn rung up and asked if I could rent tghe place minus the appliances and always been told no.

    Maybe it actually didn't work and he couldn't reach you?

    Lowly tenants have to eat too you know.

    Ignore what I just said - just reread the OP -the tenant is a scumbag lol.

    I do wonder if one of his freinds has a brand new cooker in their house (so they will be able to produce a receipt) that you are going to be charged for?
  • Attempted to be charged for. No landlord would accept a tenant insisting on a replacement for an appliance only two months old. As the owner of an appliance I wouldn't either, I'd get the flaming thing repaired under warranty.

    This a-hole needs to be strung along, preferably until it's safe to issue a S21 without the property being trashed. I suspect this one's a drug-user or in need of professional help. And that they've done this sort of thing before, or at least attempted to.

    I'm not 100% sure about this but by entering the property without his knowledge is breaking the law/agreement?? I may be wrong but make sure you dont tell him you have been around - he may use this against you if he is the scumbag that he sounds like!!

  • The OP hasn't said that they've entered the property without the tenant's permission. If they have, I'd be keeping very quiet about it, too.
