Hi,
For the basic rate of ESA to continue to be paid you need to have lodged an appeal on GL24, i would advise you to dothis as a large number of appeals heard by an independant tribunal actually are successful but the onus is onyou to provide the evidence to support your case and any evidence from your CPN, Pychiatrist and GP would be fully considered. The points system is a threshold of 10 for being classed as incapable for work if it is purely a mental health issue. You should seek advice either from your local authorities welfare rights service or CAB, your local MIND organisation may advise you where the local support is if you get no joy. Best of luck.0 -
Through the letter from the Cpn and welfare rights who the Cpn contacted the decision has now been overturned and im back on support group Esa.0

The threshold for ESA is 15 points.
The threshold for those with mental health problems is 10 points when on IB.0 -
Sorry my mistake you are indeed correct healy that the 10 threshold for mental health only refers to the old Incapacity benefit claims...sincere aplogies for my very basic error and i had actually come back online to correct that, but you are too quick for me healy..thanks again i hate to give incorrect advice.0

Why should anyone be "bullied" into claiming JSA when they are deemed not fit to work by a doctor and a Psychiatrist at present I am in the same position my ESA stopped on the 15th Feb having only scored 6 points on their assessment which I feel doesnt take the effects of a mental illness into account, I put in an appeal and was told to apply for a crisis loan to tide me over I travelled 7 miles to collect the payment of £23 which has to last me a week before i can ask for any more....that is not even what the "Law" says I need to live on. Today I received a call saying my appeal was rejected there was not enough information as to why i felt their decision was wrong. I now have been in touch with my Cpn to get a letter written and have taken the fax number for D.w.p so they can fax the letter to them...throughout ive been told I can claim Jobseekers allowance I for one will not be bullied into Claiming JSA and saying im fit to work only to end back up in a hospital bed.

No Cit_k they overturned the decision yesterday they said their decision was wrong based on the report they have received. Now been forwarded to the relevant section so see about reinstating my payments.:T0
