I must say you are showing great calm and resilience in all this. With the help you are getting on here I am sure you will rub the noses of these shysters in the dirt. All I can say is GO GIRL!![/QUOTE

Yes I am calm and resilient but I am also extremely determined - they left me and my son stranded in Egypt and whilst they would have been ignorant of that when they did it (and as things turned out, probably couldn't care less anyway!), they made no attempt to help me at all when I told them my situation.

Misleading statements about EC 261/2004 and attempts to intimidate me have not helped either.

Once again, thanks to everyone on here for their help and support and I will let you know what happens next!:)

Just returned from very, very nice holiday with lots of relaxation and sunshine - just what the doctor ordered!!!

Upon return, a letter was waiting for me from Jet2.com's commercial lawyer who has decided to settle 'without admission of liability to the points raised within your Particulars of Claim, principally to your reference to the EC Regulation 261/2004 as we retain our belief that we have fulfilled our obligations in this matter.'

    :j:j:j:j

Enclosed was a cheque for the full amount including court fees etc.

    :j:j:j:j

Just wanted to say to everyone who gave advice, support and help, many many thanks:T:T

and to all who may find themselves in a similar position - hang on in there and fight for your rights!

That is excellent news. Just been reading through the thread. These companies do everything possible to try and make sure people just give up. I once had to get solicitors onto airtours because we, and many other guests, contracted food poisioning whilst on an AI holiday. I think it took 18 months but they settled out of court but I was willing to go the whole way if I had to.

What a nice ending to your holiday. Well done.

Well done indeed! You stood your ground in the face of pressure from Jet 2, acted calmly and got the right outcome. To those who advised you along the way, well done also, it is an encouragement to us all.

Unfortunately, Mr_Knight is quite right, stating that a lot of airlines will do whatever they can to drag the process out, intimidate, dissuade you, all in the hope that you will lose the will to carry on the process. I had exactly the same with Monarch, & i know of others that have had the same.

We do have the AUC who are supposed to help moderate things like this, but to be honest they are as much use as a chocolate teapot. Even the CAA has it's hands tied.

There should be some sort of government regularity body that will cover all UK registered airlines, and to be able to make binding decisions on any UK airline where a dispute exists.

Well done Lewroll!!. I think the MSE team should feature this thread to show exactly how to deal with these airlines. The advise on here has certainly helped me if I ever need to go into combat.
    Well done all.:T
The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.

If we look back at post #29, it appears that they didn't do what they promised and didn't bother with a brush off defence.

Just deposited cheque into my bank account

    :j

I thought I would wait until the beginning of next week to withdraw my case (in case the cheque bounces!) - I assume that is acceptable?

Once again thanks everyone for your advice and support:)

Normailly, (i)s and (ii)s apply only to the letter under which they appear... So my reading is that you don't get compensation if there's more than 2 weeks notice. The problem is, I've still no idea what to make of the Article 8 obligations in this case, given the "orphaned" outbound leg is with another carrier.

Had the outbound been with Jet2, I'd read 8(a) as requiring them to provide a flight to the original point of departure (home).

In the first instance, it might be worth ringing them. I've had luck with Ryanair in the past when a flight got cancelled, they transferred me to a flight home to Birmingham on the same day, (it was a Liverpool flight that was cancelled).

Doh! - Cityboy posted better info whilst I was typing :)

Did Ryanair provide or refund the travel back to Liverpool?
