replacement mobile phone

Hi all, am a newbie on here so any help or advice you might have is much appreciated!
My partner bought me a Motorola Flipout phone on Orange for Christmas. He paid £149.99 for it minus £18 from my phone fund (for those not on orange this is £1 towards a new handset for every time you top up £10. You basically earn this as you top up, so I put £180 in credit on my phone to earn this money off, and it 'expires' after 12 months ergo 'use it or lose it'!). So in total he paid £131.99 plus £10 top up.
I had an absolute raft of problems with this phone, losing signal and taking ages to find one again, shocking internet connection, it would send messages 3 times of its own accord and would freeze all the time, even when ringing it would just keep playing and I would be unable to do anything except dismantle it and remove the battery. I phoned orange numerous times within the 1st 28 days and they told me to put it on 2G and then hooked me up to a T-mobile signal, all to no avail. Finally get really annoyed with them and they sent me a replacement handset as I was still within the first 6 weeks (not happy with it but was told there was no other option).:mad::mad::mad:
Got the replacement the day after (approx 9 days ago) and it started doing the same thing, losing the signal, freezing so I had to remove the battery and now cutting off calls in the middle (actually happened 4 times today, ironically twice on the phone to orange when was complaining about it cutting off calls!). Spoke to a helpful lady today who told me I was entitled to a different make and model and would get a call within 7 working days and would be offered the choice of 3 replacement handsets but she didn't know which as they change a lot.
Basically, I forgot to ask her about it and really can't be arsed phoning back to speak to somebody else and go through the whole rigmorale again! My question is, when they offer me a new handset, does it have to be of equal value to the phone I bought because obviously it was an expensive Christmas present and don't think it would be fair to be offered a cheaper one in replacement and don't want to get ripped/fobbed off!!:(

When they offer you a DMR (different model replacement) the main criteria is that its of a similar spec. The rrp might be higher or lower.0

well thats ok i guess, the phone itself i never really got to know properly (because I HATE it) but it does email, syncs all your data and whatnot into one stream (i think, im not sure) etc. anyways its quite a snazzy phone that does do an awful lot except the basics such as working, texting and making calls lol but as long as it does the same and works properly then i hope i will be happy with what they offer.0

yes because i had a nokia 5230 previously and never had a single problem with it. gave it to my partner cos he wanted it and they had me try the new sim card that came with my phone in his and had a full signal on it again. they tried everythin to get out of it but that was just one of the problems with it.0
