  • You have nothing to lose by asking the question. It maybe they just didn't read your file correctly and on looking at it again will extend it.

I have requested a copy of the letter that my gp sent in to see whether there is anything in that which would have altered my award, so we'll see.

Still don't know if it would be better to go for a tribunal or leave things and go through it all again in 2 years, but maybe leaving it would mean I am somehow accepting the way they have done the award.

What would achieve by going to tribunal?
    Gone ... or have I?

please remember that a tribunal can go against a decision made by a DM and either lower or remove the award completely

to be frank if I were in your position I would be quite happy that the award had remained the same and simply complete the forms again in 2 years

I think you may have hold of the wrong end of the stick.

A period decision means it is fixed for that period and cannot be reviewed unless there is a change in needs.

An indefinite period means that the DWP/DLA can review it at any time as they wish!

I think you may have it wrong, as basically an indefinate award means you do not have to periodically renew your benefit. Indefinite awards can sometimes be reviewed and you may need to have another medical examination as part of the review. This is from the direct gov website itself.

But then any award can be reviewed at any time..

  • Many thanks for your comments.
I think I will see what the letter says, and it its ok I will leave it as it is. As you say, there is no telling how it would go with the tribunal.
    Thanks again
  • Hi.

I have received the info from dla.

It wasn't my usual gp who completed the form for my dla and they have put 'not to my knowledge' to most questions.

It is very frustrating and most likely the reason for my award being limited to 2 years.

My usual gp knows how I am affected and I can't understand why the form was given to a gp who doesn't know me.

I am still wondering whether to ask for a reconsideration if I can get my own gp to fill in a form?

    Thanks

As you mentioned in your first post, why bother when everyone is going to have a medical anyway?

And a reconsideration can go against you as well as for you, why lose what you have now?

I have also noticed that more claims seem to now be ending in 2013 since the news was anounced about everyone having a medical because i read other forums but I only glance at them and only post here so i may be missing things.
