O2 broadband contract nonsense

Hi All

First post, apologises if it's wordy, but I'm hopping mad and need the therapy!!, about a bizarre disagreement between myself and o2.

Been an very happy o2 customer for many years, moved to their home broadband about 2 years ago. Their network offered greater speed & all round excellent customer service, couldn't be happier....

Yes...here's the but...In Jan they contacted me to do there usual what can we do for you. Paying BT's line rental had annoyed me for ages, as I only use it for ADSL connection, having a VOIP telephone service. Turned out that o2 could offer me the line rental for £7.50 per month...great. The sales guy then says you might as well upgrade to our new 'Works' internet package whilst your at it as it's our top package & you can have 3 months free!!

Kerching...sold. Two weeks later we're up and running and all of a sudden my ADSL speed drops by 4 meg. FTP transfers & uploads also half their previous speed.

Turns out the new package is traffic managed and bandwidth restricted, my old package wasn't.

I rang them and said I hadn't been told about the traffic management & I felt that this was a serious non disclosure of a material fact. They said they would review the log of the original sales call and get back to me.

After 2 weeks of chasing them, complaining by email to their high level complaints dept & OFCOM I heard today that they had reviewed the call log & concluded that the new contract had been mis sold due to the non disclosure of material fact.

They say however that I cannot go back onto my original package, because it doesn't exist anymore!!!**@!!?

So my question is...as the new contract is void due to being miss-sold do I have a legal right to require them to fulfil their original contractual obligations?


I have line rental from them now which limits my choice of other providers & I'm sure I could get them to release me from this non binding contract. All I really want is to go back to Jan 17th.

Senior manager is getting back to me, but not expecting anything other than the fob off. With 4 contract mobiles plus internet my household spends in excess of £1500 per year with o2, which seems to count for nothing. Not sure what's in 'o2's mind' but that goat from their advert better pray I dont pop up!!


So if you are with o2 & a sales person rings you trying to get you to change you can be sure there is an ulterior motive for asking!!

    They've changed their prices and trying to push people onto their new 'traffic managed' plans. Now I think you've got a choice, cancel your broadband and go elsewhere or stay. You should be able to use any provider (depending on exchange equipment) such as sky etc.

    You could also write to Watchdog... as this will affect many many people.

    No, you can't get your legacy tariff back, but you ca walk away now without any ETC, due to their breach of contract.
    No free lunch, and no free laptop ;)
