Could you confirm how you bought and where from? Was it ebay? Did you pay using Paypal, which was funded by your debit card? Or was it just your debit card?
I ask as you haven't actually said, in full, how the transaction was made. Which means some assumptions are being made.
If it was an ebay purchase, paid for via Paypal then the seller won't have your card details. All you can do is follow ebay/paypal's procedures, but as per post #7 you only have a finite time in which to do this.0 -

Even if it was from an ebay seller and paying via paypal, as already mentioned by Custardy, they are well beyond the 45 day time limit for opening a paypal or ebay dispute.0 -
I know. I didn't disagree with Custardy, quite the contrary, even before my 0936 edit (I hadn't seen your post during that edit). I did say all they can do is follow ebay/paypal procedures, which includes working within the time frame. They haven't, so they should get what they can, put it down to experience and move on; remembering for the future, if they continue to use ebay/paypal, to go there first and follow their instructions to letter. Because if they don't, then ebay/paypal will not be interested in the slightest.0

It's in China, there is nothing anyone can say or do over here to help. If the Chinese company want to give a refund they will but if not there is nothing you can do about it. If you are going to buy from China make sure you do it through ebay using paypal and if there are any problems with delivery or faults etc, get the claim in before the 45 days are up.0

It did work with an Orange sim card, just had trouble charging it and couldn't use it as an iPod as sound was distorted. And yes I sent it backed tracked and paid via pay pal0

But sometimes you can't do it in the 45 days as the fault could be after 45 days. I did however, contact the company directly within the 45 days as the fault was obvious after a few days of use. Thankyou for all your help I'll have to chalk this one up as a disaster.0

then you buy from a UK company that is covered by UK distance selling laws.
you cant buy at chinese prices and expect the protection of UK law.
its a decision you have to make when you purchase0
