    Hi Annie - I only saw your thread this morning and, whilst I don't think I can offer you any more advice than you have already received, I sympathise with you 100% :grouphug: :grouphug:
    In my opinion the Bank is behaving in a totally cavalier manner towards you - you have kept them FULLY informed about a situation that is out of your control. One simple phone call, by the bank, would have confirmed that you are telling them the truth :mad: :mad:
    It is, unfortunately, typical of the way that Banks (not just Nat West) are behaving to their clients in this 'uncertain' time - they are only interested in protecting themselves and couldn't give a monkeys as to whether you can put bread on the table!:mad: :mad: :mad:
    I would be inclined to send a letter of complaint, to Nat West Head Office, about the way you have been treated.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    I wonder how they'd feel if your DH didnt bother going to work, since its obviously a voluntary job at the moment.

    That was the only way we eventually got paid by the LEA, by saying we wouldnt be going back the following week unless we were paid, and it ceratinly got them off their backsides.

    only works though if you can afford to call thier bluff. After 4 weeks without any wages I was prepared to, especially in a nightmare school.

    Do you know thats a GREAT idea. Have nothing to lose, have just contacted the 4 other agencies that DH is registered with to see whats about. It truly is an awful school has made it into the M/E/N on three occasions during the last half term due to all kinds of things happening. So very little to lose. Will ring DH now and tell him(!) what the new plan of action is!!!!!!!!! Thanks for the hug by the way.Annie XXXXXX

    Way to go,,

    Its easy to have a misguided sense of loyalty to a school, but in reality we#re all in it for the money at this stage, I'd never teach if I wasnt getting paid for it - why should I? Why should he?

    Worst thing is that he'll get it in a lump sum ( like I did) and pay loads ot extra tax and NI, and the NI you'll not get back.:(

    To be honest its more about proving to a hea dthat he is healthy enough to actully do the whole full term full time stuff. DH ha sbeen very seriously illl(as posted on a million other threads) and this is his first full time venture back into the classroom. BUT...........at what cost? Anyway great news he has an interview on Wed at a really good school. Its also a lot closer to home. Only a maternity cover but I'm dead happy-something positive. Thanks for the support. AnnieXXXX

    There is another slightly different way of looking at this matter. I'll put my employment law hat on for a minute.

    Normally the date on which we are paid and the payment method are contractually agreed between the employer and employee. This is either written into the contract of employment, agreed verbally or established through what is called custom and practice. Now, if the pay day comes and goes and nothing has been paid then the employer is in breach of contract, as they had committed to payment on that specific date. Getting to the point, if the employee then suffers a financial loss as a result (which is what has happened here) the employer could be threatened with a breach of contract claim in a small claims court. Obviously it would be up to you to decide how to present them with this info, should you choose to.

    If my employer made this mistake they would reimburse me for my costs incurred, as long as I provide them with a letter from the bank detailing charges/costs. I would imagine that they do this as they know that their position is weak.

    Thank you so much. Hadn't even thought about it from that perspective. Will have a long talk with DH when he gets in from school tonight. You era right HE is expected to be there when required an dto work hte contracted hours. Therefore they presumably, also have obligations. Again htank you so much. Annie

  • Just posting to say I can relate to what yr going through. Im also a supply teacher and had real trouble getting my payroll number sorted last half term so I could actually get paid!!! And then 3 days pay went missing as school had misspelled my name!! So had to rejig mortgage payment etc etc

    Anyway it's all working Ok now apart from not enough work!:(

    And as for the bank ..... what b@r st@rs!!!!!

    I got into a situation with bank charges incurred for
    a) going less than £2 overdrawn .... basic account so no O/D
    b)not being informed in advance of a bank charge causing another D/D to bounce when they took it

    Have phoned my building society to say (very politely) that I thought both charges were unreasonable, explained my situation and lady I spoke to said she would write to the appropriate dept for me and would hear from them in 7 - 10 days. This was the Nationwide and found them to be helpful before when I had a current account with them a few years ago.

    My advice when you sort out all the fallout is to take your business elsewhere!! Good luck to to you & yr OH
    Orignal debt £31k 2005; reduced to just under £27k Sept 2008 New debt: Capital One Card £1000; mortgage arrears £1,252
    Current Total Debt = £29k
    Proud to be dealing with my debts!
