MBNA Are they stalling or genuine ?

I'm awaiting a response from them regarding my PPI on my creditcard.
I sent a letter asking for a copy of my original agreement and today got this responseWe refer to your request to us under section 78 of the Consumer Credit Act 1974 ("the act"). Unfortunately, we are currently unable to comply with your request.
For so long as this continues, we will not issue court proceedings against you to recover any amount owed either now or in the future. However, please be aware that you should continue to make payments to your account if you have an outstanding balance. THis is becaue your debt continues to exist and has not been extinguished, so you continue to have an obligation to pay us. As such, we are entiltled to contact you to request pay,emt if you fall behind on your payments. We are also entitled to report your prepayment patterns to the creidt Reference Agencies, including, where appropriate, registering a default against your name. This has recently been confirmed in two High Court decisions: McGuffick v RBS and Carey v HSBC.

But nothing regarding my PPI which I also asked to be refunded in the same letter due to being mis sold it as I never even knew I had it and never opted or asked for it.

I put in my claim in September 2010.
I had the PPI running for about a year or just over on the 5th August (A YEAR LATER) received a refund on to my credit card of £740.
I have not yet received a letter so I do not know how the breakdown has been calculated.0 -
I sent a letter to MBNA reclaiming my CC PPI (I'm self-employed) at the end of May 2011. I had a letter acknowledging my complaint a week later and then two letters in July saying my complaint was taking longer than expected - I also presumed they were stalling and up to their old tricks. However I received a letter last week stating my complaint had been upheld and detailing the amount I would receive (premiums back to 1998, interest and 8%). So that's about 10 weeks-ish in total, quicker than my claims with other companies. Maybe the avalanche of settlements is starting to happen, be nice to think so
They haven't sent me the money yet mind you, they said within 28 days - we'll see........
For anyone else waiting for MBNA to deal with their claim, if they say it's taking longer than expected I would try and grit your teeth and give them a just a little good grace (I can't believe I'm saying that about MBNA!). Much as it's hard to trust them the queue at the FOS is HUGE and you could find yourself waiting an awful lot longer. I've had a completely straight forward claim in with the FOS for another CC company which has taken 20 months to be dealt with, just sitting in a queue, and despite finally being upheld the CC now has another 8 weeks to contact me with a settlement figure and they're already late on that and if I don't agree with the figure it's back to the FOS and on and on it goes.........0 -

My second reply from them, letter saying that they apologise but due to unforeseen circumstances it is taking longer to respond to my complaint; they would still like the opportunity ti resolve my complaint and will do so within the next 21 days! this from answer by 4th/8. If I'm not happy to wait I can go to the FOS, along with a leaflet from FOS......I'm willing to hold on 31/8, as it seems to me that they are holding out! I WANT MY MONEY!!!Long Hauler No: 51
