    Received my letter last week - had no idea about this news story so was a bit of a shock. Had to read the letter several times to try and understand why they were giving me £2800 but im certaintly not complaining. Currently paying £750 a month in mortgage payments and £866 a month in overpayments so the £2800 is a big help to get the mortgage payed off sooner rather than later :D

    Just wondered whether you ever got a letter in 2009 to say your mortgage rate had changed to 3.5% or did they never write to you at that time?

    Yes it does state the mortgage conditions applied to the further advance as well.This morning i received a copy of the 31 page mortgage conditions which appear to be the new conditions. How they have managed to change my old conditions to the new ones without informing me is beyond belief.
    Any ideas?????

    Still waiting for any kind of letter! Just rung them and been told end of May as no longer a Halifax customer. We transferred our current mortgage and topped it up with another one in April 2005, then re-did it all with them in Oct/Nov 2005 for a 5 yr fix. We did take a couple of months payment hols due to unexpected bills that came in. Just wondering if anyone has had a payment who took a Mortgage holiday? Time will tell (hopefully!!!)

    That sounds like they haven't gone to archive at all and have just printed off a new set!! Did you get a letter at the beginning of 2009 advising you that you were going onto the new rate of 3.5%?

    As far as I can see it's not really about the mortgage condition booklet at all. I don't even have a copy of that, my mortgage offer and the further advance offer are the "offending" documents. I get the distinct feeling that they are trying to wriggle out of this further advance part, but I can't see how they can. I don't think they had budgeted for it at all. I aren't holding my breath that we will get a pay out at all, to be honest ours won't be that much anyway, but I suppose the longer they take to pay out the more that we will be owed, as I still haven't received a letter saying I am being charged 3.5%!!

    Just received a letter stating that I am on v1 2004 of the Mortgage Conditions not v2 and they will not be making a payment. However I note my amended mortgage offer in November 2004 states clearly the same confusing clause as posted earlier regarding the cap.
    Any thoughts?

    Blimey that is a clever one!!! Did you have a further advance at any time?

    Did they write to you in 2009 to say you are going onto 3.5%?

    Well, I recieved my standard letter today saying that when I got my further advance my mortgage conditions were changed.

    I just called and asked when they wrote to me to advise me they were changing the conditions. The advisor said 'It would have been on your further advance paperwork', which I had in front of me and read out word for word - nowhere does it refer to my exisitng mortgage conditions changing. I then stated that, if that was the case, it appears that my mortgage conditions were changed without my knowledge, so could they please send me a copy of the letter they sent me, advising the conditions were changed.

    No doubt I'll just recieve another copy of my FA paperwork.

    I usually use one of the many helpful resources on the web for stuff like this but I've searched and can't find any guidance for this particular situation :(

    I think it is just a case of waiting and seeing what they come up with. If you see my posts above I am a bit further on with my complaint than you and they asked me to drop a copy of my further advance offer into a branch for them to copy onto the system so they can look at it again and not pretend this time that they don't have a copy of them already! If I do not receive a satisfactory response in a response to that, I will write a letter to the Halifax setting out my claim. If this is not then dealt with properly then I will follow the banks procedure, which I believe is to take it to the ombudsman.

    Hoping it won't come to that as as far as I can see it is clear, it is explicitly stated and I can't see how they can get away from that! Still not holding my breath though! lol

    Well nice surprise - £195 cheque arrived this morning. I didnt think we qualified, as we were on a five year fix until end Jan 11, and we repaid it in mid March as we remortgaged elsewhere.

    Made my day.
