    I have now received my final decision from the ombudsman and they have decided to uphold my complaint and the Halifax have now revised their offer to us. It was a bit less than we were expecting as no part of our mortgage was on the svr at the time so it's been calculated from the point that it did revert to the svr which is fair. we have accepted the offer and are awaiting the cheque. Hopefully now we have been successful it will set the precedent for the rest of you, good luck!

    As you say the precedent has been set. Hopefully others, myself included will surely now be reimbursed for Halifax's decidedly underhand tactics in relation to this issue...!!!:T
  • Hi all.
    I have been following your posts since the day i receieved the original letter last year. your posts have helped and assisted me with my approach to the halifax. quite a lot of you mentioned about your fixed rates. and ERC connected to it. For your information today i have accepted an offer from the halifax, it was'nt quite what i expected, it was however 4 times the amount given as a good will payment. this was through the ombudsman. so to confirm, i was on a fixed rate significantly higher than the the svr. all mortgage holders on a fixed could have been given an option to switch to a lower fixed rate of 5.19% in october 2008. so if your mortgage was fixed in for higher than the 5.19% they should be refunding you the difference. all the other t&C would stand, including the ERC. im sorry if this is bad news for some of you on a fixed, on the other hand , if like me you were stuck on a rate of 6% plus this should make a big difference to your settlement amount. p.s fsa is very slow with dealing with the claim. pps. halifax are fighting tooth and nail on every claim.

    Just a quick update regarding my case to everyone who followed the trail. Just received a reply from Financial Ombudsman which says that Halifax partially admitted their fault and ready to settle for a half amount that I have asked, which is £1809.99. Obviously, it is better than £250 good will payment that they sent me. So, i am definitely happy with an outcome, even though it took me over 6 months of time to achieve this. So, Guys, if you think that you have a small chance to claim your money back, DO IT!!, because the bank will not offer the refund without you asking for it.

    DIDNT THINK I RECEIVED ANY RESPONSES BUT AM OVERJOYED TO DISCOVER THERE ARE MANY OF US STILL GIVING THEM GRIEF. ALSO, ALL THE PEOPLE WHO HAVE POSITIVE OUTCOMES CAN ONLY HELP. OMBUDSMAN RECENTLY INFORMED ME THEY ARE GAINING MORE INFO FROM HALIFAX BUT HAVE DETECTED MUCH MORE HELPFUL/POLITE ATTITUDE FROM HALIFAX TOWARDS ME RECENTLY - HAH -
    IS THERE SOMEWAY WE COULD CLUB TOGETHER MORE FORMALLY INC BOTH SUCCESSFUL + REMAINING COMPLAINANTS TO SHARE EXISTING INFO + SUPPORT EACH OTHER?
    I'M STRUGGLING WITH TYPING DUE TO DISABILITY - ANY IDEAS? :j:rotfl:

  • All I did was send one letter to L/TSB - 2 months later I was sent 2 cheques totalling £7200... DO IT!

    This is without doubt a lengthy and tedious process....
    Having submitted my complaint to the ombudsman sometime around the start of this year, I've had several disagreements with the adjudicator about the issue. He finally e-mailed me the FSA documents which detail how every complaint related to this case should be dealt with. These documents gave me a damned sight more information than was afforded me by the Halifax in their ambiguously worded letters. Alarmingly there is a clause in there which states that the ombudsman can only decide an outcome based on the parameters of the FSA documents and that fair play and common sense don't come into it. My complaint is now finally in the hands of an Ombudsman after the adjudicator conceded that I did in fact have a decent case to answer.
    I'm very pleased that others have managed to get a result from these charlatans.
    I'm still confident that the Ombudsman will find in my favour, only problem being it could be yet another 6 months before I get there.
    Soon as I know.. you'll know... be it good or bad...
