I know you can libel, I was mocking their inability to draw a distinction between written and verbal defamation. Especially when they are keen to throw their "knowledge" of the law around.

Apparently PPCs try it on all the time with Pepipoo and get nowhere. The webmaster has said that they have even "wasted" their money on presumably expensive lawyers.The reality is that online forum libel is very difficult to sustain. The vast majority of comments falls squarely within the "fair comment" defence, which is considerably strengthened by the Simon Singh case and a more recent one involving musicians.The other thing is that insults, abuse and invective are not defamation at all, as decided in the Sheffiled Owlstalk case.Of course PPC morons, especially HASbeens, would not understand the intricacy of this. It is easy to send an anonymous threatening message like a snivelling coward, much harder to actually understand your legal rights and do anything about it.

Fair comment defence love it .
So it IS fair to say that the PPC are SCAMMERS ,
in my defence I will give some examples.

Falsely implying statutory authority by using the term "Penalty Charge" (A**OA)

Falsely implying that the keeper is liable because the driver is arbitarily deemed to be acting as the keepers agent even though this is not anywhere in the parking terms and conditions and notwithstanding the doctrine of privity in consumer contracts. (R*****ghe)

And the smoking gun which I have a reasonable suspicion could very easily be defined as FRAUD :-

A Solicitor threatening a registered keeper that they must disclose who the driver is or they will apply for an order with Rule 31 of Civil Procedures re disclosure. When they must KNOW that Rule 31 does not apply to the small claims track at county court .
If they don't know then they are not really a Solicitor ..they are ..hmm what's the word ..oh yes a FRAUD. (Gr***m W***e)

PPCs are scammers and frauds and those are the polite terms !

Any comment Firebird20 or would you rather send abusive PMs to posters than actually discuss your disgraceful trade in public ?
