coming away from vodfone early

Hi i bet its been covered a million times lol
anyway i have been a vodafone customer on pay monthly since 2003 now have always been with them as has been great service etc and have never had a complaint......until now last april i took out an upgrade on a 24mth deal £25.54 p/mth with a nokia n97 mini...
now the complaint is not with the service its the phone the second day after (amazingly)the 1 mth warrenty the phone went to pot,the touch screen rfused to work correctly so contacted vodafone who told me to take in store for repair so did that was told i couldnt have a courtesy phone now needing my phone constantly this was a great inconvenience since the phone was away for 3 weeks,now on return it was deemed a faulty part was replace...great...2 weeks later same thing...back to the shop...2 weeks again back working now again the touchscreen is now refusing to work when it does it doesnt answer calls the battery life is now terrible i have to constantly keep it on charge ....in short not happy so called vodafone....to cut a long story short i am basically told tuff its not our problemm take to the store again...i cant keep doing this this is ridiculous being an 8yr loyal customer i find it annoying i have been sold a defective piece of equipment that constantly needs repair...now under consumer rights doesnt something sold to consumer have to be fit for purpose???? i have rang again and basically am stuck with this constantly breaking phone until april 2012!!!!!

what can i do basically i have had enough and want out and away from vodafone but does this mean i have to fork out a fortune to release from the contract i cannot afford to buy another phone nor do i wish to remain with a phone that doesnt work? fo another 14mths!!

    1 month warranty? Very odd for a new phone.

    Anyway, the headset and the contract are separate as it's been said many times here. You can get a basic headsed for a few pounds and use it with the sim while you sort the problems out with the faulty headset.

    We’d like to take another look at this for you. If you could e-mail the information to us via the Contact Us link on our website, using WRT135 as the subject, and a link to this thread, we’ll look at the handset issue and repair history on the account and we can then advise how we move forward from there.

    N97's are god awful phones.

    Get it repaired, sell it for as much as you can and buy something else with the proceeds. At least then you don't have to worry about the expense of buying out your contract.
