  • HI I have a criminal conviction going back about 17 years I got drunk and managed to break into a house and got done for burglary.
I was given a fine for the offence but also given a criminal conviction. Do i need to declare this conviction if it was so long ago this was a one off offence never been in trouble after that apart from mortoring offence
    can somebody please advise
I thought if the offence was over 5 years old and you did not server prison sentance you did not have to declare would be grateful for some assistance

Maybe there should be a new law passed to stop idiots posting on forums. With no time limits.

  • was that message intended for me...can you explain yourself istead of calling somebody an idiot be a little more clear
  • adventureuk, I'll answer your question.

There is an act called the Rehabilitation Of Offenders Act 1974. It lists down the length of time that you have to declare a conviction (including motoring offences) before the conviction is "spent" and you are considered rehabilitated.

You are correct in saying that after 5 years a conviction that resulted in a fine is spent and does not need to be declared.

What SailorSam was saying is that if you have a question that does not appear to have been answered somewhere else, you should start a new thread (you are more likely to get a good response that way) rather than resurrect an old one.

Still, no damage - you got your reply.
In the beginning, the universe was created. This made a lot of people very angry and was widely regarded as a bad move.

  • For insurance purposes, this conviction which was 17 years ago is not relevent and you do not need to declare it. In fact, I would forget about it completely. Good luck . . .
  • Hi everyone, I just had to register and post a reply as I had a very streesfull time trying to sort my car insurance after landing myself with a criminal record.
I had a dispute with a neighbour who left a car for sale for three months in front of my house,The car was vandalised and broken into and was a real eyesore. One morning I lost it and got my steering wheel lock and smashed the rear light. It went to court I denied it like an idiot and copped a criminal record and fine.
I learned my lessons 1 not to lie and 2 behave with a bit more class.
Anyway if you try Admiral and if the criminal record is minor ie no jail time they told me they would ignore it and base the quote on my driving record. I was delighted as I had no driving convictions or claims and had held a license for over 15 years.
I made the criminal record very clear and got two different sales staff to verify and again made known at the point of purchase.
I read through the T&C and noted that any relevant matters must be disclosed so the insurance is valid.
One point I would like to make is first enquire if the insurer will insure if one has a criminal record before giving all your details this way you can honestly say you have never been refused insurance. Admiral was not the only insurer I found there were many others so dont give up and good luck.

  • Hi nomdeplum,

I had to post this after my own experience. I found this thread because I was searching for car insurance and I have an unspent minor conviction. I went through a specialist advisor and the best quote I had was for £1200. And then we went back to our original insurer who I had got the heebijeebies about because although the chap we spoke to said it wasn't a problem we never saw anything in writing.

Anyway the short answer to the story is Elephant. they didn't even ask what the conviction was after I reassured them it wasn't a motoring conviction. and the quote was half the price, plus the price had nothing to do with the conviction, they just charge you more for Saabs!
