Can i open a dispute for item not received

I bought a new kids party dress and i only paid £4 with free 1st class postage, when the dress turned up it had a stain on the front which looked like a drink have been tipped on it, so i sent the seller a message to say about the stain and i get a reply saying if you would like to return the dress to me 2nd class i will refund you in full including the postage, so i sends the seller a message to ask if they wanted it sent recorded delivery and i get a reply saying no 2nd class will be fine and once i receive the dress i will give you the refund. So i posted the item wednesday morning and when i got home i sent the seller a message to say that i posted the item, so as i haven't had a message back i was wondering if i'm going to get my money back. .
I know i'm jumping the gun as it's only 3 days but i thought the seller would had the item on friday but saturday the latest. So if i havent heard from her by monday night should i ask her if the dress have turned up and if i don't get a reply could i open a dispute for item not received.

  • Ebay can already tell from your messages to the seller that you recieved the item!

    You should have sent it tracked by Special Delivery. If you open an SNAD you will have to prove delivery back to the seller to recieve a refund which you cannot do as you didnt send the item tracked.

Now if i payed extra to have it tracked when the seller said don't bother they may have thought i didn't trust them and just gave me back the price of the item.

    eBay would obviously be able to check your messages to the seller but the seller could also copy your messages into the dispute.

  • As has been said, you cannot open a case for item not received.

    The item may not yet be back with the seller, so I would wait a bit longer. Even though the seller said they would reimburse you to second class, you could have paid the extra to use a method which would have covered you for a paypal casement but you didn't.

    If seller does not get item back then you can claim from RM using your certificate of posting.

    However 2nd class can take several days to go through the system, so I wouldn't worry for a couple of weeks.

    Would the seller have to sign something to say they didn't receive the item as i have never claimed against rm before. Would i also get stamps as the value is under £10.

    Special Delivery would be more than the item is worth!

    I usually get cheques even for small amounts and whether or not the recipient is asked to confirm receipt is completely random.
