Appeal against motoring conviction

I think you lost most of your chances of sympathy and help from MSEers there!InnocentMan wrote:I look forward to returning to the UK at Easter when I can set off as many speed cameras as I like and my licence won't be endorseable!:j
What makes you think that the law wasn't applied fairly in your case?0 -
Bossyboots wrote:It is true. You cannot simply say you don't agree with the decision. You have to show that the decision making process was flawed or argue a point of law. Otherwise every criminal in the country would be filing an appeal just because they don't agree with the magistrates.
This is not true of a mags court decision. You can appeal on either facts or law
I have done it many many times for client who simply didn't agree with decision on facts0 -

Tongue in cheek. I apologise to anyone who I have offended by my frivolous throw away remark.0 -
wearewolves wrote:Alas, you demonstrate your haste to (deliberately?) misunderstand. Where do I state or imply your conviction was for speeding? I was referring (following my thorough reading of the thread yesterday before posting - a habit I can recommend) to your appalling statement about setting off speed cameras when returning to the UK. Now I am only aware of one way of setting off speed cameras and frankly that puts lives at risk. It may have been a bit of macho bravado that you don't mean, in which case you can say so but your response merely attempts to obfuscate the issue.
Ditto above post0 -
Upon reflection I have come to the conclusion that the Magistrates Courts are not independant, and one (especially a motorist) can not expect to get a fair and just hearing.
I was thinking just the other day, surely Magistrates, Police, CPS Solicitors must get to see each other failry regularly. I wonder how for example a Magistrate can accept the word of an officer one day and not another.
Additionally, I note the comments as made by chuckles_1066, and it is interesting to read the thread on freemasons pointed out by tomstickland.
The really unfortunate thing is I am really unable to take this matter further, I really do have too much on my plate to take these insignificant little people to task. The amount of my time and effort to recover a few hundred quid really isn't worth it, it would cost me more in my time. Furthermore, as I have already established the system is more interested in extorting revenue than facts and truth. Why would any form of appeal bring a different conclusion?
We live in a corrupt and unjust world, that is clear, and this corruption and injustice is administered by the very people who proclaim to uphold and administer the law.
I'm mighty glad to be packing my bags and leaving a sinking ship.0 -
Hi InnocentMan
You may find the following website useful:
https://www.ukdrivinghelp.info
I've received loads of parking tickets in London (surprise, surprise!) but ticketbusters (https://www.ticketbusters.co.uk) have managed to get me off on EVERY one of them...you just enter the offence code, and the website gives you points on which you could appeal. On the downside it does have a London bias and it costs £9.99 to join...and that's only for 6 months.
Hope this helps.

I think your inference that the magistrates Courts system is one of an old boys network is simply untrue. I have worked within the legal system for 29 years, 10 months and 10 days with 42 days to retire.
Magistrates are largely untrained members of society who listen to the evidence from all sides and take legal advice from the Clerk. The police have no sway over magistrates and are restricted from giving evidence which the man in the street would think is reasonable to say? The relationship with the CPS and the police is almost non existent and is normally a quick 5 minute discussion if that.
But compared to other countries and the corrupt systems operating there? I would say ours is about the best you can get but is far from perfect, however, to say it is a Police court is really way off the mark, from when police used to prosecute cases themselves without a body called the CPS.
Unfortunately the "why me" brigade and "hang him and flog him" mob do not agree that they should be subject to the law if they transgress and will often feel harshly treated, but one cannot please all of the people all of the time.
As a job or past time it would be interesting to see the day in the life of a magistrate and see what goes through their thought processes or mind when dealing with nerdowells and they are restricted by the sentencing rules etc. Maybe the public rather then criticise should try and change the "system" by volunteering to be a magistrate and remain human, and yes they too get arrested and get points on their licence ? so maybe the old boy network truely does not exist, now 41 1/2 days to go:rotfl:0 -
What a pathetic little man 'innocent man' is.
I would have a guess that i'm not the only one here that hopes that the fine that he got was really high because he clearly has no respect for the law or for anybody else.
To be honest, I hope somebody runs him off the road someday. Harsh? Maybe. But the irony of it would definetly bring a smile to my face.0 -

What a puerile post!
Get a life (and a brain cell) then come back and make an adult comment.0 -
I don't think you can judge someone from a couple of posts tbh. He posts one tongue-in-cheek comment and all of a sudden he's scum of the earth! lol. Mind you, it would help if you put up what the original fine was for, and the situation surrounding it, as people otherwise only have your minimal original first postings and 'humorous' later posts to go by, so isn't entirely helpful to anyone.
You would probably also get more luck asking over at pepipoo.com
Although I suspect any timeframe for appeal has probably passed by now.matched betting: £879.63
