Phone contract advice

Help!
I got a new phone on Monday on a 24month contract, The phone keeps switching its self off and re starts. I exchanged the phone on weds for a brand new one but this one has started doing the same thing today.
They want to exchange it again tomorrow . I have searched online and it seems to be a common fault with this device.
They also have said I can have an alternative but there is nothing I remotely like available on the price tariff I took out.
Where do I stand? They tell me I cant cancel my contract ?

For a start, try reading the Terms and Conditions that you signed up to.
I take it that you bought it in a shop - pity as if you bought it on line, there are different rules under Distance Selling Regulations.
The problem is that you have an airtime contract with the phone and that clouds the issue. The handset is faulty, but the airtime isn't. Shops give handsets away to sell airtime contracts.

Now some shops will allow you to rescind the contract if there is a real problem with the quality of the handset, but many more won't.
Try rejecting the goods under SOGA, but also consider what you want to do given that the handset of your choice is a lemon, and you want a new mobile phone and a contract. See if they will agree to swap over.
On the matter of your second post, bear in mind that yesterday was Saturday and people do have lives other than to be unpaid advisors on here.
If you take your petulant attitude to the phone shop, I can almost guarantee what the outcome will be in advance.0
