Still in 3 grace period considering cancelling

I got accepted for the blackberry 9300 £25 a month, 24 month contract.Have always wanted a blackberry especially for emails on the move etc.

However im facing a bit of buyers guilt and im concerned with such a long contract, and phones evolving so quick ill be 6 months in and want to cancel as the phone will be out of date and ill be fed up of paying so much for it!

I just wondered as im in the grace period whether i would be able to negotiate something with 3, perhaps keeping the phone but using it on payandgo with a discounted price for the handset for example.

  • Simple and quick answer is that you signed the contract 3 will not negociate with you to lower the contract. Why would they let you keep the handset and go PAYG ???? They wont back their 30x24 monthly payments
    If you have picked the wrong handset return it. If you always want the latest handset do as I do i have a £10 per month sim only deal and buy sim free handsets

    If you can't afford it you could always offer to buy the handset from 3 but they are unlikely to let it go at anything less then full price. Then you could unlock, (pay to do this) and use your own chosen sim. If you stay with 3 you don't need to pay to unlock.

    From what I was told by 3 (and I may well have been lied to so check this out) as soon as you put your sim into the handset you have as good as confirmed you want to stay on the contract. That is what they told me anyway.

    Yeah, they state that on their T+C's, however I think that breaches the Distance Selling Regulations which states you have 7 working days to inspect goods and returning them if not suitable. How can you tell if it's suitable unless you use it?!?!?

    Did you buy it online or in the shop? DSR does not apply if the latter. You can potentially reject the handset if faulty, but you are also in a contract for 24m airtime (which is in effect a second contract), and you are now locked into that.
    I don't understand your issue with phones going out of date in 6m. Most smartphone contracts are now 18m or 24m, how else can you get a £500 phone for £25 a month except on a 24m contract?
    As tazdevil says, if you must have a new phone every 6m you'll have to buy SIM-free and pay full price.

    The distance selling regs are there to make sure you're sent the right make, colour, model ect. It's not there to give you 7 days to play with whatever you order and then return a second hand item which the merchant can't sell as new.

    With anything techy, you need to do your research before you order.

    its not so much a case of having the latest phone, im used to having bricks etc im more worried about the contract really. ive had credit problems in the past and im getting twitchy about signing up for it although i have learnt my lesson from previous mistakes im not willing to go into anything lightly now. i ordered online and havent touched a thing.

    I just wondered really whether i could offer to keep the phone and pay for it as if i was purchasing a pay and go phone, and cancel the contract as im still within my 14 day cancellation period

    Why do you think they will do that when they have £600 to earn from you over the next 2 years? How much are you prepared to offer them to switch you to PAYG? If you can afford that now, then put the £600 in the bank and see out your contract.

    In my experience with 3 (which dates back to 2005, just left yesterday:D very happy having done so!) They seem to make up the rules as they go along. This is both a good and bad thing, they can cause you to make the wrong decision as well as helping you out so personally, I'd call them up and ask them, see if they can "help you out", explain your worries about not being able to pay the bills in coming months, they may have other options for you, if they know maybe they will have extra paperwork which could be avoided.

    Just an idea.

    Hi, if the phone is still in the box with the seal on the box unbroken and you havent tried the the sim in that phone or any other phone, they MAY let you return it and cancel, or if youve opened the box but not used the sim they may let you buy the phone but it wouldnt be at a subsidised price so would be in the region of £200. If they refuse then your only other option is to buy-out the contract at £25 x 24 = £600 so you might as well just let the contract run. If you have used the sim you are probably stuck with the contract.

    hi thanks for comments. the box has been opened, phone not touched battery not inserted or sim and am going to cancel. the phone is not hugely expensive on pay and go. £170? i believe. im still in the cooling off period to change my mind. Just wondered whether i could cancel the contract and pay them £170 for example to keep the phone and go on 3 pay and go
