We normal refer cases like these to the rent officer where meals are included under the substantial board and lodge rule. It's up to the rent officer to decide whether this case would be treated as lha or odrt.

I really can't see hb being granted anyway as to be this is a contrived tenancy there is no way I would grant hb

    Sorry

    odrt?......
  • October deregulated tenancy. Basically a pre 2008 claim but post 86
I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

Yeah a deregulated tenancy, its just when the rent officer makes the decision on the maximum of hb for that property, same as lha in a way really :)

Thank you all for your inputs.

It has given me valuable information, and an insight into things I knew nothing about.
WHEN.....my Grandson starts getting his JSA, he will of course pay towards his keep, but then comes the difficult decision on 'how much', and what he needs for his daily living allowance to be retained by him.

Life is hard! And then you get a Grandson parachuted in. Must do something about him doing his own washing and ironing though. I'm semi disabled, and my Wife has had two seperate heart bypasses, only just surviving the second one........We didn't need this as well!

    Thanks again!

Maybe he could help around the house as part of the keep he gives you? You could sit down and talk to him - explain that money is tight but you obviously want him to stay if he needs to because your his grandpa and you love him. As he isn't working he will have enough time to help you and this way he still understands about paying his way (if he doesn't already) without feeling pressured about money or like that's your focus. I also find having something constructive to do and feeling you contribute does wonders for your self-esteem even if you don't contribute money or work in a job :) I know it doesn't solve the money situation and it'll still be tight but it seems like a short term solution that benefits everyone.

How is his job hunt coming along? How is he occupying himself in the mean time? I only say because while I'm sure your grandson is a lovely lad being unemployed and young can be really depressing if you don't have something to keep you going and cheer you up.

    Wrong way round.

He pays for his keep and if there is anything left over, he gets it for himself. Don't let him start giving you what he has left over from his spending money as this is unfair, will only cause trouble and will deter him from getting a job.

    Cooking? Cleaning?

This is the time for him to learn some good house-keeping skills - ask him what nights he wants to cook the family meal and which type of cleaning and tidying he'd like to be responsible for...

It is a good opportunity to teach him about budgeting and looking after himself. The worst thing you can do is let him get too comfortable - for his own sake as well as yours.

People on means tested benefits who don't live in the same property as close relatives are eligible for local housing allowance.

Someone of your grandson's age who is single would get the equivalent LHA rate of an average cost of a room in a shared property. You can identify this rate on the LHA direct website.

The vast majority of tenancies (and some lodgings) exclude all bills. Someone on means tested benefits will not have to pay council tax but it still leaves a youngster on JSA just £50 a week that needs to cover food, electricity, gas, water, telecoms, travel, clothes and so on. So if he moved out, he would get LHA, but then struggle to afford other essential costs.

Proposed changes to the benefit system mean that in future, the LHA rate will be based on the bottom third of local market rents so the rates are declining. Secondly, those on JSA for more than a year will have a 10% cut in their LHA.

the govt has just announced the 10% cut proposal has been ditched

Thanks for the reminder. I think I posted this before the announcement of the change and then it wouldn't have occurred to me to go back and update my post.

I didn't agree with triggering the long term unemployed into homelessness anyway, which is what that proposed change had the potential to do. It was unworkable anyway.
