O2 mobile phone

My husband took his Blackberry mobile, which he purchased last August, in to O2 and they sent it away they are now saying it is damaged and has a faulty motherboard, the phone has not been abused or dropped or sat on as they are insinuating, he took it out of his coat pocket. The contract he has signed up to is 2 years. Does anyone know what are his rights?

    Contract is not a 2 year phone warranty its just the network .
    Phone comes under standard terms of the Sale Of Goods Act .


    they are now saying it is damaged >> then it does not come under warranty

    and has a faulty motherboard

    I would want a written engineers report as to the damage and probable cause .

  • What it could be worth doing is sending it off to RIM (Blackberry) for a second opinion, but if they confirm it's been damaged (a sharp knock or bump maybe?) then the best you can hope for is a goodwill gesture from O2 if you were complain.
