Need help with questions about DRO

I am currently applying for a Debt Releif Order with National Debt Line, it hasnt gone to court yet but it soon will do. I have some questions though and hoped you knowledgeable folk may know the answers or advice please? Sorry so long winded and so many questions !!! Thanks in advance for helpful advice.

We completed the income and expenditure sheet for NDL months ago (between October and December last year 2010) and since then

the VAT has risen adding to the cost of some of our bills (normally by less than £1 per bill but even the pennies add up)

Food has become more expensive, so has everything else.

our Tax Credits have gone down.

In the next few months we are due to get the new annual bills for such household expenses as Council Tax, Water rates etc etc and I am sure there will be an increase on last years costs. Therefore our living expenses will go up. We will also have a review on our Tax Credits so these may go up or down again creating change either way.

My husbands income has changed (he is doing less employed work but more self employed work) but its not risen considerably.


Are we better off completing a new DRO application?

Will I be able to open a new bank account?

What happens if I get another job offer?? Theres even a possibility I may become Self Employed again, but the first few years wont see any profits and just break even. What happens in this situation?
Will I be allowed to open a business bank account? Or a personal one for that matter?

Will they track my spending / accounts and expect receipts as proof of what we spent our money on, say for example in the supermarket?

What happens if our creditors / debt collectors change the day it goes to court? They all seem to be going from 1 place to another at the moment and we regularly get letters saying theyve moved to a different company.

I know we have to call them up on the day it goes to court to make 100% accurate of the amounts we owe and who to. But what happens if they wont tell us over the phone? I have had it in the past where I have phoned for this information and even after passing the security bit they cant tell me over the phone only send it in the post and it takes up to 14 days to process and receive it !!
Im really apprehensive of this as I havent spoken to any of them in over a year (as theyre just plain spiteful bullies the lot of them) and am stressing out over it. Can I not ask my advisor from NDL to do this for me on the day?

DROs do not go to court. They are processed by your intermediary on the information you provide.

    Are we better off completing a new DRO application? It must be the information re income and expenses on the date of the application that needs to be used. If you feel they are not accurate you must update them.

    Will I be able to open a new bank account? Yes, try Barclays or the COOP.

    Will I be allowed to open a business bank account? Or a personal one for that matter? You must inform the OR of any change in income / circumstances within the 1 year moratorium period. If disposable income raises significantly the DRO MAY be revoked.

The IS will sort out any situation re being passed to someone else.

Give the lastest figures you have, cross ref with experian report and over estimate a little.

    I already have a safe bank account with Coop and I also hae a bank account with Barclays but have been advised to stop using this one as I also have debt with Barclays themselves. I used the Barclays account (which was previously a business account which was converted into a personal one by Barclays when I ceased trading due to the business not being successful enough to keep open) I then used the account to use for funds for a small club I run, but have been advised that Barclays wont care if this is not my money they will take it as an asset and seize it anyway.

    I have been told by my advisor that our application MUST be completed and submitted before 1st March otherwise it will have to be cancelled as its taken so long to process (Christmas / New year on top of the 12 week wait for NDL to deal with it not helping of course). Im just concerned at how long it will take to re-submit before the creditors run out of patience (they already have I think) and start acting against us to get their debts back.
