Can we claim unfair LOAN charges. I've been charged for letters and phone calls around £25 for each.
After sending them the pre-warning letter about court. Sainsbury's bank has written back stating that refunding bank charges only applies for overdrafts and credit cards. Is that true? please advice.

If they are charges for late/missed payments then Sainsbury's are lying - you can claim them back as they are disproportionate penalties.
If this is the case, make your extreme displeasure known in your next correspondance theyt have blatently tried to mislead you.0 -
i am in the same boat and have been charged £18 for letters and phone calls . What should I put in the letter to them when asking for my money back ???0

Sainsbury have written back to me stating that the OFT ruling on bank charges does not apply to loan agreements. Charges were applied due to late monthly payments. They have charged 25 for letter/call charges.
Can I claim these charges? please advice.

The OFT Ruling applies to Credit Card Late Payment Charges.
The basis people are using to claim back bank charges is based on the common law. The OFT Ruling does, however, support the basis that charges should be proportionate and should not represent a penalty.
I would make it incredibly clear to them the legal basis on which you intend to make the claim. If they still refuse to budge, issue a claim. It is highly unlikely they will take it to court.
