Incapicity benefit and working

The time to have come clean would be before starting work. If I commit murder and admit to it before I am caught does that mean I should not be tried in a court of law?
(Sorry missteapot, not comparing the offence to murder, just demonstrating the point!)
I agree he should have come clean initially yes, but he didn't. Yes, he's a thief and should be punished.
However, in this time of cuts and wasting public money then I feel it wouldn't be in the public interest to take him to court. Better to penalise him by removing any future benefits for a set period and then make him pay back what he claimed.
As for the last comment about murder - you know I'm not implying that so I will just ignore that comment.0 -

It is not up to you how to punish a criminal, that is up to the judiciary.passatrider wrote: »Very true..but then I've seen do-gooders on here who have harped on about permitted work as if it's defrauding the taxpayers blah blah blah.
You can't win sometimes with people!:(
The difference between permitted work and not declaring work is one of lawfulness.Gone ... or have I?0 -
Miss teapot please dont help him out financially either directly or indirectly while he is paying it back (e.g. i need some money for fags. Im a bit short this week. Can you lend me some cash) He might try the old emotional blackmail trick. I had this with an ex who was in debt to a bank through frivolous spending. Your boyfriend got himself into this mess. He has to get himself out of it. He has to take responsibility for his own actions. You used the phrase hes on his own THIS TIME. Has he been irresponsible before or done anything like this before and you have had to bail him out?0

any one caught commiting benefit fraud should be excluded from getting any future benefits, that would soon stop the thieving scum ripping us all off, one strike and your out, this country is too soft on cheats and we have too many do goody, yoghurt knitters making the rules. the only way to make the system fair is to get tough.Be Alert..........Britain needs lerts.0 -
Just for the record if he'd kept his hours at 15/week he could have kept his incapacity benefit, claimed return to work payments and got a back to work bonus as well. Been there, seen it, done it.0

I've given up reporting fiddlers to the powers that be. Why? I reported people who were claiming nursing home fees despite having a second home which they let out. I was ignored by HMRC, DWP and the local council. What made me really mad is that branches of the family have homes on Sandbanks, which is around the third most expensive place on the planet to buy property.0 -

So his crime was not knowing the rules properly. :Tpaddedjohn wrote:With a bit of luck he will end up in court on fraud charges. Its not an unfortunate mistake to claim when you shouldnt, its theft from the state/taxpayer and leaves the pot that little bit emptier for the genuine claiments.
You have to factor all the money they've saved by defrauding people out of what their due which of course disencourages people being honest.0 -
Don't worry he will have to repay all the benefits that he fraudulently claimed. IB, HB/CTB etc etc.missteapot wrote: »Hi there, need some advice. I have just found out that my idiot of a boyfriend has still been claiming his incapacity benefit while working!!! He hadn't worked for over 2 years due to severe depression and anxiety and was getting incapacity benefit, housing benefit, council tax benefit, cold weather payments, etc. With my support he found a job last September - 16 hours a week minumum wage but has now told me that he never told the job centre that he had started working as he didn't want to loose his benefits. He was still receiving his benefits until last week but they have now stopped. I suspect that someone may have reported him. I can't believe he has done this and am worried what will happen now. Any advice would be appreciated.*SIGH*

And if he's been receiving CWPs as well, as stated by the OP, I assume you can add Income Support to the list as well.0
