    ESA assesses your ability to do any job at all and supports you in getting said job. It does not assess your ability to carry out your previous/current job so if your current job is causing you stress but another job wouldn't cause stress then you wont qualify for ESA after the medical.

    ^^ Agreed. From what I gathered, you have to be actively seeking work in order for a tribunal to pay compensation for constructive dismissal. (They will order your employer to pay roughly a weeks wages for every week you have been out of work, if they find in your favour and ONLY if you have been actively seeking work.) If you have no intention of working, then the tribunal could see it from a different point of view, i.e. you would have been off your work anyways so are not due compensation as your employer is not at fault for your inability to work.

    I guess what I'm trying to say is that you will have to prove to the ET that you are looking for work before they will consider compensation from a "loss of earnings" point of view. :think:
