questions about ESA medical assessment upcoming soon?

I have heard that now govenment cuts anything, so the ESA medical assessment isn't such easy to pass,30% of people appeal now.

I have suffered work related stress for more than a year. and off from worked related stress caused depression since june last year while my employer's redundancy/consultation also still keep going.They stopped my payment as well and I'm now get ESA benefit since January 2010.My employer wishes to get rid of me and stop me back work which is the root to cause me real stress and depression actually. Since it is unfair redundance/consultation process ,my solicitor sue them harassment to me.I was experience bully and harassment from employer over a year actually which caused me depression.

I read a website about the score system that the government will use for ESA medical assessment.

I read all through and found no any score will be toward employer's attitude toward sick employees, if the employer can't create a friendly and relax work environment for mentally sicked person, how they can return back to work? especially like my case, my employer still wishes to get rid of me, redundancy/consultation is on going , my case is in tribunal now which haven't solved. not only I 'm still suffer mental health issue --but also actually I can't return back to work due to my employer's attitude . But does the professional asessment doctor from government will concern employer's attitude ? especially like my special case?

My medical assessment will take place this Thursday very soon.

    Aside from the fact that your post makes no sense, surely if your stress is caused by your current role, the answer would be to look for a new job?

    I think I would have to agree with DMG. If stress and depression is being caused by work, then the answer does appear to be quite simple - find a different job.

    The idea behind ESA is primarily to get people back into their job. Obviously that is no good for you, is it?

    What is the point in claiming ESA if you know what will improve your life no end. Not being able to find another job is a case for the jobcentreplus and a claim for JSA.

    ESA is supposed to be a benefit to get disabled people into jobs that they can do. Unless you meet the criteria for the support group (doubtful from your OP) then you will be expected to prepare to return to work when claiming ESA anyway so you might as well start job seeking now as a lower stress job will probably get rid of your illness anyway.

    Mine was last Wednesday, not had a response from it yet.

    You can only tell them how it is.
    I wouldn't try lieing belive me they will see through it.

    They will ask you questions relevent to you and your work.

    actually I'm suffering depression for a year, I have doctor's prescription for anti-depression and other related sickness such as sleeping problems, back sore and body pain etc and been emergency in hospital a few times during the passed year.My sick notes always work related stress and on fit for work.How can say I just easy to find a new job? meanwhile I'm still employed currently
    But my employer tried hard to stop me back to work unfairly--redundancy/consultation is still on going,( it isn't natural redundancy ,it isn't a group of people potentially need to be redundant for the consultancy, I have brough millions of pounds new revenue for the company, just followed a personal relation broken with MD, that's why this potential redundancy happened to me and lots of harassment followed afterwards and they stopped my payment unfairly as well)
    my case is in tribunal already, I need lots of time to fight for my employer legally as well. I have mountains of paper works for tribunal. but my solicitor said the tribunal will take at least one year time . Can people just starving to fight unfairness ?

    If you wish to fight your employer you should do that in your own time. ESA is not there to finance you through the Tribunals process.

    I was expected to work a 20 hour week, study full time uni and fight a tribunal case after being sacked for having major heart surgery. It is stressful but fighting a tribunal doesn't entitle you to benefits.

    i agree what dmg say ..lokk for a new job, which is better for you , ands still do the tribunal thing, as i think is constuctive dismissale

    of course ,ESA is support your living while you off from sick and can't work.not for legal at all. I didn't mean that is for legal.

    I mean My case is special , not only physically I sufffer mental health issue ,but actually I can't back to work due to my current employer issue. and even you wish to find a new job, it doesn't mean the new job can come to you overnight. you are still employed which not entitled for JSA.etc

    ,isn't it? you can't just resign which you will be nothing for benefit.isn't ?

    my question is that whether the ESA assessment also could consider employer's element , such as my depression is caused by employer and currently the employer is still stopping me back work.
