You should be alright, I have done this previously with Orange when I didn't get on with the one I got. If I remember rightly they said something in the terms to try and put you off doing this (can't remember what), but I managed to sell it and get a different one with no problems.0

Even if you default on your plan and they end up cancelling your contract I have never seen Orange ask for the phone back. Not recommending that you do that, however I have sold phones straight after receiving an upgrade as I was perfectly happy with my old handset0

The phone doesn't form any part of the contract, that is for airtime only. The phone is a gift/sweetener to encourage you to take out the contract.0
