Hi guys,
I'll try and make it short and sweet.
I've been having ongoing problems with T-mobile (haven't a lot of us) and I wonder if you can help me.
I had some problems last year paying my t-mobile bill and ended up owing them money.
I contacted customer services, and told them of my situation and to this I entered into an agreement to pay them back in instalments which I have been doing (even paying more than they wanted so I could clear the debt off)
Since I entered the agreement with them I have been having serious problems with my smart phone crashing all of the time.
Having spoken to T-mobile about this, they told me that they have stopped my data allowance to the phone until I pay off the remaining balance and then It will be reinstated.
This was last year and my phone has been crashing all of the time.
Along with this, my balance does not seem to be going down much either.
I have tried to reason with them about my phone being unusable by the fact that it keeps on crashing, but there response is "buy a cheap phone until you get your arrears sorted"
Now is it me, or have I the right to cancel the contract under the condition that the phone which I purchased from T-mobile is unfit for purpose due to it crashing all the time?

One other point I wanted to add.
They have also told me that all of my loyalty credit (three years worth) has all gone and I'll also have to set up a new plan when I finally pay off the arrears, which may mean I'll be on a worse data plan that I was originally on (3gb)

Any answers would be appreciated.

You breached the contract by not making payments. They have therefore come to a (seperate agreement) ti let you pay what you owe. Quite frankly, you have been lucky in continuing to use the service. Most networks would have ceased your service completely; you would then have to pay to reconnect.
As for the handset, if it's faulty and under warranty then use that to get it repaired.
