Revoking approved and agreed VR

I work as a public health consultant (medical)for a pct in London. In the recent restructuring, my post was removed by the pct during consultation and we were offered vr. I applied for vr which was approved and I accepted it with the exit date agreed. All these happened during the consultation period and before the final structures were out which didn't have my post either.

On the 12th, just 2 weeks before the date of my leaving, my line manager told me that the pct was revoking my vr and going to reinstate my post. Neither the vr approval letter nor the policy mentioned the possibility of this and I have already handed over many of my work streams, informed the key people, cancelled the child minders and booked a long holiday to India.

I would be grateful if you could melt me know where I stand legally on this issue.

    for some of our redundancies valued over a ceratin amount - i think 50k we had to get SHA sign off, meaning people who were wanting to go got turned down, however their VR letteres did say pending SHA sign off....

    it may have something to do with this of your package would have been over that amount....

    sorry to hear it, as it must be horrid to get messad about...

    I'm stunned by all the views but only 1 response. In my case I took VR one December but unlike just about everyone else who left at the end of that month I had to stay until the end of March (which by mutual agreement became the end of April) I was asked 3 times to stay and offered more money. I have since read it can be withdrawn at any time although I didn't know that at the time. My amount was slightly less than 50k (what's SHA?) so don't know about that.
  • Sorry to hijack thread but Im in similar situ..when informed of large scale redundancies I requested voluntary redundancy..this was accepted I have recived notification of termination date..and my payment but since this the situation has improved they want me to stay but I dont want to..legally can they refuse payment(not large) ...I have since got another opportunity elsewhere

    Your position is no longer redundant, therefore you will not be made redundant, hence no pay out. You can of course still leave, you'll just receive no redundancy pay.

  • Thanks for reply CFC..doesnt seem fair...if an employee offered their resignation to switch employer but that fell thru they couldnt INSIST on the original employer taking them back...

    To be fair it is so much easier for an employee to leave and employer than an employer to get rid of an employee so it works both way

    Have they officialy withdrawn the redundancy in writing.

    If they have then there seems to be not a lot you can do other than rejecting the withdrawel on the grounds you have another job, depending on the HR they may or may not accept that. Some will because an ET might go in your vavour for some or all of the payment anyway.

    If you want to leave any way it might be worth getting some legal advice on the likely outcome of an ET. I have seen both sides argued, so actualy going to an ET if they don't pay up is the only way to find out in some cases.
