If the question asks about cancelled policies then it need to be disclosed, you might be able to mitigate the effect by explaining the circumstances but don't risk non disclosure

    Not exactly true.

If you took it to this extreme, you would be requiring every cancellation that was made mid-term to have to be disclosed.

The Insurers have reason codes they add when a policy is cancelled and only certain codes are reported. These relate to non disclosure, fraud and nothing to do with customers that have problem paying their premiums.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

You should read my posts thoroughly before posting unhelpful opinions which are irrelevant to the situation.

My account has had and will have money in it. Co-op insurance failed to take payment from me.

    But that is the case!

It makes no difference when an insurer cancels your policy, it is on your record as a cancelled policy and needs to be disclosed.

May very well be true but until the web sites start asking questions like "have you ever had a policy cancelled for non disclosure etc" I'd still disclose.

There is nothing ambiguous about the question "have you ever had a policy cancelled?" and no defence for not answering it honestly.

It's similar to the "material facts" thing, the FOS have said it's not up to policy holders to guess what the insurance company considers to be a material fact, they need to ask clear questions and I say the same about cancelled policies, it not for the policy holder to guess what sort of cancelled policy does or doesn't need to be declared

Yes and we did not recieve any correspondance until 17th Jan which was the same day that I rang to arrange another bank account to take payment from AND THEY AGREED TO, even sending us a letter of confirmation along with a direct debit mandate.

As I have stated way too many times today for people who refuse to listen or read in your case.

Stick a formal complaint in, send in COPIES of the letter you have confirming the new payment method and a letter from you bank confirming that no attempt was made to take payment and I can't see how they can defend.

Keep a track of any extra costs you have incurred and add those in too
  • Thankyou vaio.

The team leader is writing us a letter explaining that the policy was cancelled in error and is also prepared to start a new like for like policy for the same price as the last one.

But that does not help with the fact of a prior cancellation and future quotes. The team leader told me that I would not have to disclose the cancellation, BUT as you say the question is not ambiguous so I disbelieve what she told me.

Well atleast now they are admitting fault on cancelling, so thats a start i suppose. I feel like phoning the FOS when I recieve this letter, or marching down to CAB with it.

Wait and see what they put in the letter.

If they say the cancellation was their admin error, or words to that effect you can accept it need not be disclosed in future.

(Though keep the letter in a safe place just in case they make another admin error and it comes back to bite you sometime in the future!)
  • Oh I will laminate it lol

I just hope this thread can help someone else who gets treated in this way. These people think that they can get away with whatever they like and do not realise the impact that it has on peoples lives. People who work for these type of companies arn't allowed to have a mind of their own or any commom sense anymore. I seems that if you don't fit the criterea to suit the computer they cannot help you.

What a shameful way to earn a living.

I'd be pushing for them to reinstate the old policy, it's not impossible, you just need to get high enough up the company food chain
