My husband was declared bankrupt on 8th October and we are in the process of having this annulled (dec22nd) but we are having so many problems its untrue! To cut a long story short i always do food shopping on a friday so off i go to Asda and fill trolley get to checkout card declined even though we had £1400 in the account when i ran to cash machine it ate my card! Found out saturday morning that the bank have frozen my account.. I contacted the official receiver who said there shouldnt be a problem releasing some of the funds to myself as it was a joint account but the bank refused its now tuesday we have had no food in the house for 3 days the electric meter is running v low and the gas meter has run out (we are on tokens) The kids are eating at my mums as they are only 4 n 6 and my midwife is telling me to eat healthily to be eating at all would be good! Any advice gratefully received

Hi Vicky
OMG im so sorry to hear of your circumstances
Have you tried phoning to Or again?
Also were you not advised that the bank could freeze your account ?Official DFW NERD 189
I may be a woman but dont hold it against me:D
Officially declared Br 6/11/06
Discharged Br 4/5/07 (6 months to the day)

Also i would go into the bank and cause a right fuss and tell them that you cannot feed your children or heat your home as this is taking away your basic human rightsOfficial DFW NERD 189

I dont think that was a long moan at all considering what youre going through.
I dont have any experience and others may come along who can advise you better but I would get back in touch with the OR and tell them that the bank has refulsed to release funds to you.
You are in a vunerable position, with 2 young kids and presumably pregnant as well ( midwife) so you should be able to get things moving.
ALso complain to your MP next time they have a surgery - cos its getting rediculous when they are putting kids at risk
in the meantime - get in your cupboards and make a ist of everything in your cupboards ( no matter how obscure or old) and post it on the o/s boards and we'll give you suggestions for meals so you dont starve in the meantime before the bank gets their head out of their a""e

Presumably you are pregnant? Go into the branch and kick up a HUGE fuss in the lobby area, refuse to go to a side room and very loudly detail what they have done to you and how the bank are prepared to let a family freeze in November and let a pregnant woman and two children starve when the OR has asked for funds to be released for these purposes.
Call the OR again ASAP and ask them for help too.

oh and when you do go into the bank to complain dont forget to take your kids with you so they see who is going without because of them.

I know it's not an immediate answer, but can you open a bank account in your name only and get all your benefits (child benefit, child tax credit & anything else you get) put straight in there?
Definitely agree with going to the bank and refusing to leave until they sort it out - and contact your local paper too if you don't mind people knowing, it's the sort of story they love. Can your midwife do anything to help? Even a letter of support about the amount she expects you need to pay out on food to keep your family healthy may help. The last suggestion I have is Social Services for an emergency payment - you need to eat and to keep the house at a reasonable temperature, so they may be able to advance you something for a couple of weeks.

Thanks all for your support
I went into the bank yesterday after speaking to the OR who said she would fax a letter through to them on our behalf.
I went straight into the halifax and asked the lady if i could speak to somebody in private as it was a delicate matter and a very small town and she asked what i wanted to complain about! i replied no complaint and tried to explain the situation with the support of my mum who was told to mind her own business as this acount had nothing to do with her! She went on very loudly and asked where the money in the bank was from and i when i replied wage cheques (my oh is self employed) she informed me that this was ny oh money and not mine anyway. By this time i was in tears and I asked again for a private room and was told no.The lady stood behind me heard every word andf passed me a complaints procedure leaflet!! The official receiver rang me again last night and said the bank were messing about and she would be in touch this morning but i have still heard nothing despite leaving messages on asnswerphones etc Am very dissappointed with my treatment in the bank as i have had the same account for 18 years and my huband has been on the account for 6 i didnt realise i would be bankrupt as well! Although we were warned the bank may freeze they said they probably wouldnt as it was a joint account. If they had just given us a bit of warning we could have opened another account elsewhere instead they let me pay £900 of cheques in on friday and then closed it friday afternoon!0 -
Vicky, this is bureauocracy gone mad and a disgrace too. Definately go in the Bank maybe with a friend or 2 and the kids. Tell them your situation and that you will not leave until you are allowed some of YOUR money, could your husband not go too.
Perhaps CAB could help or your MP. I also know Christians Against Poverty and charity who help people out of debt have a fund to help people out in the short term.
Let us know how you get on.0 -
HUGS to you
